Box 12854 Pittsburgh, PA 15241 71:1001a Dear Digest Customer: As a user of the Digest of OSHA Medical and Environmental Surveillance Specifications, Third Edition, you will be interested to know that, as of the date this message comes to you, this work remains relatively little affected by post-publication regulatory developments. Thus, little adjustment is required for current use. The principal regulatory developments involving the Digest third edition since its publication, together with pertinent comments, are: A) The U.S. Supreme Court ruling vacating the 1978 permanent OSHA benzene standard; CFR 29, XVII, 1910.28 ('7/2/80). Digest Pp. 4 and 5. Comment: Since the Digest indicates (see the note designator after the benzene title in Col. 1, Pp, 4 and 5 and on Pages 17 and 19) that application of the benzene standard was under a stay of execution at the time of publication, this court action has little effect on Digest use in.regard to the standard. Now, as before, the legally effective rule on benzene remains the permissible exposure limits given in CFR 29, XVII, 1910.1000, Table Z-2. These limits are shown in Digest Appendix A, Page 23. B) Application of the OSHA permanent standard on access to employee exposure and medical records; CFR 29, XVII, 1910T20m(8?21/80). New standard. Comment: The following points are pertinent: 1. This new standard gives employees exposed to toxic substances or harmful physical agents, their designated representatives and OSHA representatives a right of access to all of the involved employees' exposure and medical records and to analyses thereof. Previously, access to such records by employees and designated representatives was limited to those instances in which the access was authorized by individual standards. For OSHA, this same access authority was previously conferred under the interim final OSHA rule 1910,20 which preceded the final rule. The Digest covers this OSHA broad-access authority under its notes "AD" (see heading above Cols. 16-21 and on Page 16) in Digest Part A tables and "at" (see heading above Cols. 18-20 and on Page 19) in Digest Part B tables. 2. Employees exposed to toxic substances or harmful physical agents are to be informed on entering such employment, and at annual intervals, as to their right of access to and the availability of their exposure and medical records and any analyses thereof. 03-31-81(3)(R) ten 7999 71:1001b - 23, Unless otherwise provided by specific OSHA standards, employers are required to preserve each employee medical record for employees covered by this standard for at least the duration of employment plus 30 years and each exposure record for covered employees for at least 30 years. C) Issuance of amendment to OSHA permanent standard on occupational noise exposure; CFR 29, XVII, 1910.95 (Issued 1/16/81; effective A/15/81). Digest Pp. 6 and 7. Comment: This amendment leaves in effect the 8-hour time-weightedaverage (TWA) exposure limit of 90 decibels contained in the present permanent standard (Digest Page 6) and requires employers to make audiometric testing available annually to all employees exposed to a TWA level of 85 decibels or more. These provisions are the same as in the existing proposed noise standard (Digest Pp. 12 and 13). To make using the Digest as easy and rapid as possible, the specifications it presents are grouped into separate environmental and medical surveillance categories. At the same time, the worker exposure titles to which the speci fications relate are identical in both categories and are presented In the same order on facing pages. Thus, for any particular worker exposure, the two types of information -- environmental and medical --- are easily found in a single page opening and may, if desired, be readily considered together. Standards Classification In each of the two parts of the Digest -- Environmental and Medical -- regu latory specifications are divided into two series with their respective titles (i.e. , worker exposure designations) being listed alphabetically In each Instance. Those specifications listed first In each part are from regulations which are not established as permanent standards or emergency temporary stand ards and are now legally effective, except for those instances In which liti gation has resulted in court orders currently staying their application. The remaining listings are for proposed standards and criteria documents which are in process of evolving into established standards but are not legally effec tive at this time. The purpose in including them is to indicate what jobs and processes may be legally subject to health regulations in the relatively near future and to advise on indicated health surveillance procedures. Proposed standards are regulations which have been processed by OSHA to the final stages of standards development but, for one reason or another, have not yet become permanent standards. Criteria documents contain technical informa tion and recommendations for standards pertaining to particular worker expo sures and are forwarded try the National Institute of Occupational Safety and Health** to OSHA for subsequent standards development by OSHA. * U.S. Department of Labor ** U.S. Department of Health, Education, and Welfare TEN 8005 2 Action Level While Digest column headings and titles are generally self-explanatory or are explained by notes or other references in the table, there is an instance in which a further word may be helpful to those unfamiliar with OSH A terminology. This concerns the heading "Action Level" over Columns (9) and (10) in Part A - Environmental Surveillance Specifications. OSHA uses the term "Action Level" to indicate an exposure level which, if exceeded, will require for the exposure involved (1) environmental monitoring as indicated in Part A - Cols. 11 and 12 and (2) medical surveillance procedures as specified in Part B of the Digest. Thus, exposure values above the "Action Level" are made to function as a "trigger" for initiating medical surveillance procedures and, frequently, additional environmental monitoring as well. Typically, when an "Action Level" value is shown, it is one-half the value of the threshold limit value or, if none, the ceiling level value. When no value is shown in the "Action Level" columns, medical surveillance is usually required if exposure levels exceed a permissible exposure limit shown in Columns 5 through 8 in Part A. However, final determination on this point should be made by consulting the relevant regulations themselves. Appendices In the appendices of the Digest will be found additional specifications con tained in OSHA health regulations. Appendix A contains a list of legally effective worker exposure limits for numerous substances, many of which are not presently the subject of criteria documents or standards contained in the Digest tables proper. Appendix B contains an example of OSHA specifications for educating and training workers exposed to substances covered in those OSHA health regulations for which a hazard education program Is indicated in Column 29 of Digest Part B. However, for any given exposure, the example may not be an exact specification and final determination of education and training specifications for a particular exposure is to be made by reference to the relevant regulations themselves. Appendix C gives an example of OSHA specifications for labeling and posting notices concerning hazards involved In working with substances covered by the agency's health regulations. Here too, the example may not be an exact specification for a particular exposure, and final determination of posting and labeling requirements for a given exposure Is to be made by reference to the relevant regulations themselves. Exposure Code Numbers A feature of the Digest is its use of code numbers (Col. 2) to identify individual types of worker exposure and associated regulatory specifications. This can .greatly simplify references to such exposures and specifications. For example, when both the person referring an employe for a required examination and the medical unit which is to perform the examination are equipped with the Digest, the examination request needspecify no more than the appropriate exposure code number(s) in order for the medical unit to quickly consult the Digest (Part B) and identify the particular medical TEN 8006 3 observations (Cols. 5-17), communications (Cols. 30-35) and recordkeeping provisions (Cols. 18-20) which are called for. This applies for examinations conducted outside as well as for those conducted in company medical facilities. Once assigned to a particular type of worker exposure, a Digest code number remains with that exposure. Thus, even though the regulatory status of specifications for that exposure changes (and, with it, the governmental identification number), Digest users need not change their code number for that exposure. Subsequent editions of the Digest will continue to use that code number to identify the latest OSHA specifications for that exposure. Frequency of Digest Publication Since Digest content is based on regulatory documents issued by OSHA, the frequency with which new editions of the Digest are published is influenced by the rate at which regulatory documents are issued by OSHA. During periods when the OSHA issuance rate is high, new editions of the Digest may be published at less than annual intervals. In times when the OSHA issuance rate is lower, the interval between Digest editions may be well over one year. Thus far, the interval between Digest editions has ranged between twelve and fifteen months. Perspective In fulfilling its mission, the Digest presents in considerable detail the health surveillance specifications of OSHA regulations; However, it should be appreciated that the same condensation that provides Its ready-reference value limits the ability to express all specifications in full. Thus, in some Instances, the Digest user will be referred back to the relevant regulation itself for additional information. However, when this is necessary, the aim is to make the Digest description reflect the general purpose of the specifi cation and to include as much detail as Is feasible. i ) * * Finally, It should be recognized that while the Digest deals in detail with medical and environmental monitoring, communications, and record-keeping provisions of OSHA health regulations, it covers other aspects of the regula tions' less definitively or not at all. Thus, it should not be supposed that the Digest provides a complete summary of OSHA health regulations. (B) Consult applicable regulations or criteria document for detailed procedure. (C) Notice to nearest OSHA office required whenever (a) fatality and/or (b) 5 or more persons are sent to hospital (CFR Title 29, Ch XVII, Sec. 1904); R = Report(s) identifying in-plant regulated area(s), type of activity, number of employees involved in regulated area(s) and other information shall be made to the OSHA Area Office.(F) U = A report identifying each workplace where the subject substance is present and giving particulars of use is required to be sent to the nearest OSHA Area Office. (M) Does not apply to construction work within the scope of 29CFR Part 1910.12 nor to working conditions of employees with respect to which other federal agencies exercise statutory authority to prescribe or enforce standards or regulations affecting occupational safety or health. (N) As necessary to comply with provisions of this regulation. This frequency and fraction of employees sampled may be different if so directed by a professional industrial hygienist. (JJ) Employee(s) involved shall be notified of the exposure and of the control measures being implemented to correct the situation in writing within 5 working days. (KK) Employer shall assure that no employee is exposed to skin contact or eye contact , with the subject substance(s).
