CIVIL ACTION NO. 1998CV02684 IN RE: ALL ASBESTOS-RELATED PERSONAL INJURY OR DEATH CASES FILED BY BARON & BUDD, P.C. IN FULTON COUNTY, GEORGIA IN THE SUPERIOR COURTS OF FULTON COUNTY, GEORGIA Defendant, GARLOCK INC., responds to Plaintiffs Subpoena Duces Tecum (attached to Plaintiffs Fourth Amended Notice of the Deposition of the Corporate Representative of Garlock Inc), as follows: GENERAL OBJECTIONS 1. Plaintiffs Subpoena Duces Tecum seeks information going back to the 1930's. Garlock has made a good faith effort to identify and produce documents germane and relevant to Plaintiffs subpoena. However, Garlock has found it difficult, if not impossible to retrieve all of the documents that are potentially responsive to the extremely broad requests tendered by the Plaintiffs. Garlock is producing numerous product catalogs and advertising brochures going back many years, but Garlock does not represent or guarantee that all catalogs or advertising brochures prepared or issued by Garlock over the past seventy years are being produced in response to Plaintiffs request. Garlock does represent that it is producing all relevant and responsive material that has been located in its corporate files after completion of a good faith search by Garlock employees and counsel. Garlock also represents that the catalogs and advertising brochures being produced do identify the gasket products x.l> manufactured and sold by Garlock since the 1930's. Garlock generally objects to all requests in the subpoena on the grounds that the requests are overbroad, vague, ambiguous and unduly burdensome and not reasonably calculated to lead to the discovery of admissible evidence. 2. The subpoena seeks production of aN documents relating to all gasket products manufactured/sold and distributed by Garlock from 1930 to the present. The requests are not limited to Garlock asbestos-containing gasket products identified by Plaintiffs in this litigation. Additionally the requests are not limited to the time frame or job sites at issue in this litigation. Therefore, the requests are overbroad, unduly burdensome and are not reasonably calculated to lead to the discovery of admissible evidence. Garlock objects to all individual requests for production set forth in the Subpoena Duces Tecum on the grounds that the requests seek information not relevant to this litigation. 3. The subpoena is duplicative of earlier requests made by Plaintiffs counsel to Garlock in the asbestos litigation. Garlock affirmatively asserts that it has responded to numerous requests for production propounded by Plaintiffs counsel in thousands of asbestos cases over the past two decades. In its search for documents and materials responsive to these requests, Garlock has determined that the majority of documents potentially responsive to these extremely broad requests have previously been produced to counsel representing the Plaintiffs. As evidence of these prior productions, and in support of Garlock's position that Plaintiffs counsel already possesses much of the material requested herein, Garlock attaches as Exhibit "A", a copy of the Exhibit List 2- - filed by Plaintiffs counsel in these cases. Garlock objects to the Subpoena Tuces Decum filed here because said requests are duplicative and cumulative in nature. A request that Garlock produce identical or substantially similar catalogs and advertising brochures in this litigation is unduly burdensome and oppressive. 4. Garlock objects to all requests in the Subpoena Duces Tecum to the extent said Subpoena requests the production of trade secret or proprietary material and said material will not be produced absent an appropriate protective order. Garlock affirmatively asserts that the documents produced are samples of the information maintained in Garlock's microfiche database regarding product sales. Garlock maintains a microfiche database regarding sales going back to 1978. The database contains information regarding the identity of customers, dates of sales, the style number of products sold (by product code), the amount of product sold and the value of each sale. If requested, Mr. James Hefron will detail the nature and scope of the microfiche database at his September 10th deposition. Garlock's previously filed Responses to Plaintiffs Master Set of Interrogatories and Document Requests (attached as Exhibit B) stated that Garlock would search its microfiche database for post 1978 sales to customers, job sites and employers at issue in this litigation. (See Answer to Interrogatory 13), and Garlock reiterates its willingness to proceed with Plaintiff specific searches of the microfiche database. The hard copies of the sales 4- - documents referenced in the microfiche database are currently stored at a warehouse in Palmyra, New York. Garlock does not presently have access to those documents because of litigation involving the building. However, a search of the microfiche database will provide the identical sales information contained in the documents stored at the warehouse.
