Op het moment is dat inderdaad de insteek van de restrictie, ook om te voorkomen dat er zeer grote PFAS-houdende stocks worden aangelegd die dan nadat de restrictie in werking treedt voor een tweede keer in de handel worden gebracht. Als daar grote problemen worden voorzien, is het goed om dat in de consultatie aan te geven, zodat SEAC dat mee kan nemen in haar overwegingen. Het is duidelijk dat producten die al in de handel zijn gebracht voordat een verbod ingaat, niet zijn onderworpen aan een verbod. Echter, zoals je ook zelf aangaf, een product kan meerdere keren in de handel worden gebracht (`tweedehands'). Een voorbeeld is een gebruikte auto, die via de een dealer opnieuw wordt verkocht. In dit geval is er namelijk ook sprake van placing on the market. In Annex XVII wordt dan ook onderscheid gemaakt tussen `placing on the market' en `placing on the market fort he first time'. Stel dat ik mijn auto inruil een dag voor het van toepassing zijn van een verbod, en die auto wordt een week later door de dealer verkocht. Uit jouw bijdrage begrijp ik dat dat niet is toegestaan.
