Lombardozzi - Pampa " SUBJECT: Court Delays OSHA Emergency Temporary Standard for Asbestos The recently (November 4, 1983) issued emergency temporary standard (ETS) on asbestos has been stayed by the Fifth Circuit U.S. Court of Appeals. The ETS which lowered the OSHA permissible exposure limit from 2 fibers/cc to 0.5 fibers/cc will not go into effect pending further order of the court. The stay of the ETS came as a result of a suit filed by the Asbestos Informa tion Association, a group sponsored by the asbestos industry. Although the court would like to resolve this issue as quickly as possible, it will probably be sometime after the first of the year before the court takes any further action.
