The Administrator of EPA has delegated the authority to issue this Order to the Regional Administrator of EPA Region 6, who has further delegated this authority to the Director of the Enforcement and Compliance Assurance Division. FINDINGS 7. Respondent applied for and was issued NPDES Permit No. NM0020681 (permit) under Section 402 of the Act, 33 U.S.C. 1342, which became effective on April 1, 2022, with an expiration date of March 31, 2027. At all relevant times, Respondent was authorized to discharge pollutants from the facility to waters of the United States only in compliance with the specific terms and conditions of the permit. 8. Part I.A. of the permit places certain limitations on the quality and quantity of effluent discharged by Respondent. Those discharge limitations are specified in Appendix A, which is incorporated herein by reference. 1. The City of Truth or Consequences (Respondent) is a "person," as that term is defined at Section 502(5) of the Act, 33 U.S.C. 1362(5), and 40 C.F.R. 122.2. 2. At all times relevant to this Order (all relevant times), Respondent owned or operated a wastewater treatment plant (facility) located at 1595 Animal Shelter Road, in the City of Truth or Consequences, Sierra County, New Mexico, and was, therefore, an "owner or operator" within the meaning of 40 C.F.R. 122.2. 3. At all relevant times, the facility acted as a "point source" of a "discharge" of "pollutants" with its wastewater discharge to Rio Grande River in Segment 20.6.4.103 of the Middle Rio Grande Basin, which is a "water of the United States" within the meaning of Section 502 of the Act, 33 U.S.C. 1362, and 40 C.F.R. 122.2. 4. Because Respondent owned or operated a facility that acted as a point source of discharges of pollutants to waters of the United States, Respondent and the facility were subject to the Act and the National Pollutant Discharge Elimination System (NPDES) program. 5. Under Section 301 of the Act, 33 U.S.C. 1311, it is unlawful for any person to discharge any pollutant from a point source to waters of the United States, except with the authorization of, and in compliance with, an NPDES permit issued pursuant to Section 402 of the Act, 33 U.S.C. 1342. 6. Section 402(a) of the Act, 33 U.S.C. 1342(a), provides that the Administrator of EPA may issue permits under the NPDES program for the discharge of pollutants from point sources to waters of the United States. Any such discharge is subject to the specific terms and conditions prescribed in the applicable permit. 9. The permit also includes "Monitoring and Reporting Requirements" that require Respondent to sample and test its effluent and monitor its compliance with permit conditions according to specific procedures, in order to determine the facility's compliance or noncompliance with the permit and applicable regulations. 10. The permit requires Respondent to file certified Discharge Monitoring Reports (DMRs) of the results of monitoring. DMRs filed by Respondent show discharges of pollutants from the facility that exceed the permitted effluent limitations established in the permit, as specified in Appendix B, which is incorporated herein by reference. 11. Part I.B. of the permit requires Respondent to comply with a Schedule of Compliance, for specified activities, to attain final effluent limitations of hexachlorobenzene. The schedule also includes the submittal of quarterly Progress Reports to EPA and the New Mexico Environment Department (NMED) on January 30, April 30, July 30, and October 30 that apply to the prior three-month period. To date, Respondent has not submitted any Progress Reports. 12. Pursuant to Part III.B. of the permit, Respondent is required to properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by Respondent as efficiently as possible and in a manner which will minimize upsets and discharges of excessive pollutants and will achieve compliance with the conditions of the permit. 13. On January 12, 2023, an inspection of the facility was conducted by NMED inspectors, on behalf of EPA. The inspection report is incorporated as Appendix C. CWA-06-2025-1712 Page | 2 14. As a result of the inspection, it was found that Part III.B. of the permit was violated in that Respondent failed to properly maintain all facility systems of treatment and control (and related appurtenances). Specifically, the following findings were noted in the inspection report: a. The bar screen was non-operational; b. the grit chamber was non-operational; c. the clarifier weirs were damaged; and d. the polymer pump for the belt press was non- operational. 15. Each violation of the conditions of the permit described above was a violation of Section 301 of the Act, 33 U.S.C. 1311. SECTION 309(a)(3) COMPLIANCE ORDER Based on the foregoing Findings and pursuant to the authority of Section 309(a)(3) of the Act, 33 U.S.C. 1319(a)(3), EPA hereby orders Respondent to take the following actions: A. Immediately take all measures as necessary to comply with permit conditions. B. Within 30 days of the effective date of this Order, submit all reports, updates, and other pertinent information, as required under Part I.B., Schedule of Compliance, of the permit. Submit a comprehensive plan for the 3. elimination of the violations describing in detail the specific corrective actions to be taken. The plan shall include a detailed schedule of corrective actions within the shortest possible time, as well as measures to prevent the violations from recurring. March 31, 2025 D. If Respondent would like to arrange a meeting with EPA to discuss the violations alleged in this Order, Respondent should contact EPA within thirty (30) days of the effective date of this Order. The meeting will be held at the Region 6 offices, 1201 Elm St., Dallas, Texas, or through a virtual platform, as appropriate, and Respondent can provide any information it believes is relevant to this Order. Y N NA Introduction: City of Truth or Consequences WWTP NPDES Permit No. NM0020681 COMPLIANCE EVALUATION INSPECTION DATE OF INSPECTION: January 12, 2023 A Compliance Evaluation Inspection (CEI) was conducted at the City of Truth or Consequences Wastewater Treatment Plant (WWTP) on January 12, 2023, by State of New Mexico Environment Department (NMED) Surface Water Quality Bureau (SWQB) Inspector-In-Training, Jason Martinez, and NMED SWQB Inspector, Daniel Valenta. This facility is a major- Publicly Owned Treatment Works (POTW) classified under the federal Clean Water Act (CWA), Section 402 National Pollutant Discharge Elimination System (NPDES) permit program and is assigned NPDES permit number NM0020681. The facility design flow is 1.06 million gallons per day (MGD). The City of Truth or Consequences Wastewater Treatment Plant discharges into the Rio Grande which is subject to New Mexico water quality segment 20.6.4.103 NNMAC (20.6.4 NMAC State of New Mexico Standards for Interstate and Intrastate Surface Waters). Designated uses of Segment 20.6.203 NMAC are irrigation, livestock watering, wildlife habitat, marginal coldwater aquatic life, secondary contact and warmwater aquatic life. The NMED performs a certain number of Compliance Evaluation Inspections annually for the United States Environment Protection Agency (USEPA). The purpose of this inspection is to provide the USEPA with information to evaluate the permittee's compliance with their NPDES permit. The enclosed inspection report is based on observations made by the USEPA and NMED inspector. Findings of the inspection are detailed on the attached EPA form 3560-3. There was an opening conference, credential presentation, and closing conference with the City of Truth or Consequences Wastewater Treatment Plant representatives the day of inspection. The NMED inspectors arrived at the City of Truth or Consequences Wastewater Treatment Plant at approximately 1100 hours. The two (2) NMED inspectors were greeted by the one of the City of Truth or Consequences employees, Jesus Navarro. Shortly later, Pete English, the Director of Water and Wastewater joined for the opening conference. The compliance evaluation was limited to the NPDES individual permit. The closing interview was conducted at 1600 hours and NMED inspectors left the facility at approximately 1630 hours. Treatment Process: The City of Truth of Consequences Wastewater Treatment (WWTP) processes municipal wastewater for the City of Truth or Consequences, NM and the Village of Williamsburg, NM communities. The combined population of the communities is approximately 6500 residents. The WWTP utilizes an extended aeration- activated sludge treatment process. The plant has gone through some updates since the last evaluation by NMED in such as upgrades to an ultraviolet (UV) disinfection system. It is noted that the lead operator for the facility had joined the facility in mid-late 2022. Influent is gravity fed to the WWTP through the headworks, which utilizes mechanical bar screens. The influent then moves to a grit separator system; the grit separator has been non-operational since before 2016. From the grit separator system, the influent moves to the extended aeration racetrack. Scum that accumulates in the racetrack is diverted to a scumbox and thence to sludge drying beds for drying, and then it is removed and sent to a landfill. Wastewater moves to a splitter box and is diverted equally into two (2) clarifiers. There is an additional screen at the splitter box to catch any additional solids. In the clarifiers, there is evident short circuiting occurring. The weirs have damage, City of Truth or Consequences WWTP NPDES Permit No. NM0020681 COMPLIANCE EVALUATION INSPECTION DATE OF INSPECTION: January 12, 2023 holes, and gaps that should be repaired and fixed. The return activated sludge (RAS) is returned to the extended aeration racetrack near the grit chamber in a continuous process. The waste activated sludge (WAS) is sent to a belt press where a polymer is added (the polymer pump set-up was non-operational at the time of inspection). Sludge is then placed in the drying beds. Effluent then moves to a UV disinfection channel before discharge into the Rio Grande. The facility uses an ultrasonic totalizing meter and has one (1) outfall. The effluent passes through a 9" Parshall Flume prior to discharge to the Rio Grande. Sample collection occurs at the Parshall Flume. There are rocks and rip-rap directly below the discharge point to prevent erosion and increase aeration. The effluent falls and cascades down the rocks. There was no wildlife or animals observed at or near the discharge point. Additionally, some of the effluent is diverted to a reuse pond for water reuse in the city parks. Further Explanation This section is arranged according to the format of the enclosed checklist (EPA Form 3560-3) Section A- Permit Verification - Overall Rating of "Satisfactory" Findings: The permit was renewed in 2022. The address provided for application is the mailing address for the facility, not the physical address. There is one (1) outfall as described in the associated permit and the location of the outfall was approximately 33 06' 49.66", -107 16' 54.64". Section B- Recordkeeping and Reporting Evaluation - Overall Rating of "Marginal" NPDES Permit NM0020681, Part I, Section B. Schedules of Compliance B. SCHEDULES OF COMPLIANCE The permittee shall comply with the following schedule of activities for the attainment of state water quality standards- based final effluent limitations for hexachlorobenzene: Activity Months from permit effective date 1. Determine exceedance causes, if applicable 6 2. Develop control options, if needed, evaluate and select control 12 mechanisms 3. Construction of selected control mechanisms, if any 24 4. Attain final effluent limitations 36 or less The permittee shall submit quarterly progress reports to EPA and NMED in accordance with the following schedule. The permittee shall also include the following in its quarterly progress reports: design completion, construction start and construction completion if any. The requirement to submit quarterly progress reports shall expire after written final report has been submitted. No later than 14 days after the date compliance with the final limits have been met, the permittee shall submit a written final report both to EPA and NMED, stating that compliance has been completed. If at any time during the compliance periods the permittee determines that full compliance will not be met within the time allowed, a separate report shall be sent to EPA stating the explanation for this delay and proposed remedial actions. City of Truth or Consequences WWTP NPDES Permit No. NM0020681 COMPLIANCE EVALUATION INSPECTION DATE OF INSPECTION: January 12, 2023 PROGRESS REPORT DATES: January 30, April 30, July 30, October 30 The permittee should note that each date applies to the prior three month period. Progress and final reports shall be sent to the agencies (EPA and NMED) mentioned in the Part I.C below. Findings: The facility is monitoring and reporting the pollutants identified in Part I, Section A. Limitations and Monitoring Requirements. The facility has not provided reports or updates regarding the compliance schedule listed in Part I, Section B Schedules of Compliance for the hexachlorobenzene effluent limitation. The permit has an interim and final limitation in the Limitations and Monitoring Requirements table. The compliance schedule requires determination of exceedance causes within 6 months of the effective date (April 1, 2022) which would make the initial update due in September of 2022. At the time of inspection the compliance schedule had not been updated. The facility has had a non-detectable value for hexachlorobenzene since 2020. The facility has been not met the effluent limitation for dissolved oxygen (DO). It is recommended by NMED that the sampling location for this be moved from the Parshall Flume to a point closer to the riprap. There is a noticeable amount of aeration achieved from the discharge point to the rip rap and thence to the river. Additionally, the facility neglected to complete the fourth quarter WET testing for 2022. The facility should conduct the required sampling and submit results in accordance with permit requirements and associated timelines. Section C- Operation and Maintenance - Overall Rating of "Marginal" NPDES Permit NM0020681, Part III, Section B. Proper Operation and Maintenance 3. PROPER OPERATION AND MAINTENANCE a. The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by permittee as efficiently as possible and in a manner which will minimize upsets and discharges of excessive pollutants and will achieve compliance with the conditions of this permit. Proper operation and maintenance also includes adequate laboratory controls and appropriate quality assurance procedures. This provision requires the operation of backup or auxiliary facilities or similar systems which are installed by a permittee only when the operation is necessary to achieve compliance with the conditions of this permit. Finding: At the time of inspection there were several pieces of equipment that had functional or operational issues. At the headworks, the barscreen is intended to have steps which rotate and drop solids in a waste container, but the mechanical operation was not functioning. The cyclone grit separator system was non-operational at the time of inspection. At the belt press, the polymer pump had recently become non-operational. The most noted operation and maintenance concern would be at the clarifiers. The weirs had multiple points with structural issues which resulted in short circuiting. Some of the weir bands had holes in them and were not level to support even distribution of overflowing water. Section D- Self Monitoring - Overall Rating of "Satisfactory" Findings: The permittee noted appropriate factors for sampling such as location, time, flowrate, etc.. There were no concerns noted on the facilities self-monitoring criteria. Section E- Flow Measurement - Overall Rating of "Satisfactory" NPDES Permit NM0020681, Part III, Section C Monitoring and Recording 6. Flow Measurements Appropriate flow measurement devices and methods consistent with accepted scientific practices shall be selected and used to ensure the accuracy and reliability of measurements of the volume of monitored discharges. The devices shall be installed, calibrated, and maintained to insure (sic) that the accuracy of the measurements is consistent with the accepted capability of that type of device. Devices selected shall be capable of measuring flows with a maximum deviation of less than 10% from true discharge rates throughout the range of expected discharge volumes. Findings: The ultrasonic flow meters were calibrated in 2022 but the effluent flow meter did not have documentation. It is recommended for the facility to follow up for the calibration record. Section F- Laboratory - Overall Rating of "Marginal" Findings: The facility performs dissolved oxygen (DO), total suspended solids (TSS), total residual chlorine (TRC), and E. coli sampling in-house. For E. coli the Colilert Quanti-tray method was utilized. TRC would only be examined in the event chlorine was utilized for disinfection. The last TRC reported value was November 2022. Thermometers need to be calibrated and a record of calibration maintained. Weighing scales had been calibrated and recorded. The facility has been unable to meet dissolved oxygen (DO) permit limitations. The sample is collected at the Parshall Flume; NMED recommends the facility attempt to sample at the point the effluent meets the rip-rap to better capture the aeration achieved with the rip-rap prior to meeting with the Rio Grande.
