Dear Mr, Kull:
This is a follow-up letter to bring you up-to-date on the status of the above captioned claim.
The case has been pre-tried and is now on the current trial list in Workmen's Compensation Court,
As a result of the Pre-Trial, a medical report has been exchanged with the petitioner's attorney. His report from his medical expert, gives disability of 100% permanent
total as a result of the pulmonary disease and relates it to
exposure
at his place of employment.
As you know, our medical evaluation by Dr, Theodos likewise finds
to be
a total disability as a result of this pulmonary disease but does not relate it
to his employment. Therefore, the issue is obviously one of causel relationship.
C onsidering
_ duties and exposure at his place of employment, I do feel
that the case has very substantial exposure in Workmen's Compensation Court. Before
this case is tried, we will discuss in further detail the--opi-aion ofSt, Theodos,
particularly from a standpoint of "aggravation". ^
We will keep Mr. Corrigan, the local Plant Personnel Manager, alerted as to upcoming
trial dates,
