The Refuse Act--seetlon 13 of the Rivers and Horrors Act of 1&99--prohibit* discharges (except fro* streets and severs In liquid fora) Into navigable voters or their tributaries In the ebsence of permit fro* the Secretory of the Aray through the Arsqr Corps of Engineers. Violotors of the Act ere sub ject to crimlnol prosecution end civil Injunctive proceedings. Decisions of the United Stetes Supreae Court hove construed the Act so being directed ot pollution as veil os obstructions to navigation. 2. In recent years, a rapidly grovlng nuaber of legal actions have been brought under the Refuse Act for voter pollution control purposes In eases of dis charges In the absence of a permit. Recent proceedings by the Justice De partment against firms discharging aercury are an exaaple. lovever, the permit authority contained In the Refuse Act has never been used. 3. In order to make the asst effective use of existing Federal legislation to achieve coapllanee vith voter quality standards, a permit program under the Refuse Act is being initiated pursuant t: an Executive Order of the President. This program will be actively used to supplement enforcement authorities in the Federal Water Pollution Control Act. Initiation of the program, hovever, vill not diminish Administration efforts to obtain needed improvements in that Act. (Proposals to strengthen the Act, submitted to the Congress last February, have not been acted upon during this session.) II. The Permit Program The Permit Program villi 1. III. Effluent Guideline* To facilitate more preclee determinations of compliance with applicable water quality atandarda, most of which presently require "secondary treatment or its equivalent," the Environmental Protection Agency will refer to and encourage states to use effluent fuldellnee which It la now developing to define the indus trial equivalent of secondary treatment as well aa a "best available level of treatment" for major Industrie*. Host of these guidelines are scheduled for completion by June of 1971 and will be used as soon aa they are completed. IT. Enforcement 1. 7he criminal and Injunctive measures that are available to deal with Refuse Act violations will be actively utlllted to achieve compliance with water quality standards, with respect to continuous discharges from manufacturing operations aa well as accidental or Infrequent discharges. Current guide lines of the Department of Justice with respect to litigation under the Refute Act are being revised In accordance vlth this policy. 2.
