Bird shingles were installed on Dr. Moliken's roof in 1975. At today's cost, replacing a roof costs about $100 per square, which includes labor and material. The roof in question is 60 squares. The Bird shingles have been on the roof for 15 years of a 25 year warranty period. Based on the above numbers, without disputing the merits, a payment of $2640 would make Dr. Moliken whole. Mr. Patenaude offered $1320 to settle the matter last February. In light of the time and expense of trial, Mr. Patenaude's offer is fair, even when measured against $2640. If litigation is commenced, I will defend Bird myself, at little or no cost to the Company. Not withstanding the above, and without admitting liability, I am willing to settle this matter for $1500. If this offer is not accepted on or before January 17, 1990, it shall be deemed revoked. Please advise.
