of manpower has permitted Industrial diseases to creep Into the ccm-

going to make it snmwhJt easier for us in patting over oar next year's

I have your letter of March 9. Hr, Davis case to see *, accoapanied ty Mr, Fia*u#i Personnel Manager nf the Union Oar-Son
Carbide Cospa tty.-- Mr* Daria is ths htd of the department dealing with power development for this Company and struck va as being a vwty de
cent citissn and seonod to be quit* well informed on the whole subject of atlloosifl.
* ' I hart heard frea a number of sources about the high nor*
t*Htr that has been attendant upon th construction of this tunnel. The. suits are being brought against the contractor and the^ insurance con-
pany and Union Carbon and Carbide isapparently not liable.- Hosetot, they harp denuded, to loot into the natter 'thoroughly and be of anah afe
aistgace as cirgungtanges nay ekrrent to the contractor In defending these
suits.

X pcIntad out to Mr. Davie, and aa far as 1 could nabe out, he
got the sue advio* frow_3ayrww JfchaV thw thing to do was to establish ^ *
first of all whether those aide nan had silicosis and'for that purpose*-;
1 suggested that he consult Dr. Pancoast* My on opinion ia that if .* j
these ux ware found to have silicosis and they had worked under cendi-- ^;j!
tlons exposing thM to silicosis; th* suits had better be settled. Of J-J*
course, there is a strong probability that many of these MD were old -1
hard-rock worker* who nay have had silicosis when they went to work for>
the contractor* Mr. Davis was anxious to establish the status of respired
tors and I advised bin to get In touch with yeu both as to type and as y
to the tlx* when various types appeared on the asrkat.

A 1 imagine that there are probably Bone genuine cases of sill*,
costs nixed up with a number of sore or leas fraudulent suits. The uajhrl*
ty of these people brlhgW **iti are negroes and naturally the whole
think has bean gglajgai tar aona cltyar Uiyr. 1 do hot know who the 1
contractor is but I expect they have got his across a barrel* A nuabaf ~
of suit* hare been filed on behalf of persona nos dead and I believe theti^.
lungs have been secured,
advised Mr. Davis to consult Dr. oardnsr
for this phase of the job* I shall be glad to give you any further dope
if 1 have any* -

Dr. Anthony J. Lanza, Assistant Medical Director. Metropolitan Life Insurance Go., New York: City.
My dear Dr. Lanza:
I am in receipt of your letter of the 7th of July and T want to thank you sincerely for the very genuine and candid criticism you have offered.
I find, however, in. reviewing my plates and the literature once again, that I cannot possible come to any other conclusions.
IA hMaBVvQe feltU mUWodsUt deeply, tVh44eu qaiHttUebmiU^pI Htsd WoAf WcoWnUfBeAreBUnWcel s to establish Silicosis as a distinct entity without due regard for the differential diagnosis, in my private work, in the Health Department and in Court, I have been astounded to learn how readily diagnoses of Silicosis are made by physicians where I would not dare to commit myself. In too many oases, I have found them wrong. The problem Beemed to me to be most acute in Court and I have therefore stressed that aspect of it.
I would certainly be insincere if I were to accept conclusions w_h_ich were _n d___i*rec.t O. ppos.i.ti.o__n_ I to w.haAt *I h&vo1__________A found in tuj work. These conclusions, which I have found, are by no means final. I would certainly be the first to correct them should they be proven wrong* Just now, however, I see the need of throwing the question wide open and encourage a more detailed study of it.
The faota I have offered should, I feel, become pert of the literature,
Again with warmest thanks for your interest and with best wlahea, I am
Very sinoerely yours,

Mr. R. H. Pass, Second Vice President, Onondaga Pottery Company, Syracuo, H < T
Dear Ur. Pans!
I have your letter of March 14, together with the report prepared by your laboratory, both of which 1 have read with groat Coal of Interest*. X
think that the report h*e been vary carefully prepared and confers#. In tho maih,
to tho generally aoeoptod opinions with regard to this eubjeot, with perhaps acme
minor exception#. 1 should like to offer the following comments*
Page 1 - Slllooale and other forma of pnaumaaacontosis do of thoagolvea cause death. There la plenty of evidonee for this. On account of the tendency of alllcctloi to contract tuborealouia, the majority of case* die of tuberauloflis. X think It is always important, especially in these legal natters not to give the impression that silicosis and pneumonoeonlosis are interchange able term#. Wo know practically nothing of other forma of pneuaonoQonloBl#. We do know quite a good deal about silicosis.
Page 3
- the diagnosis of silicosis ty I-ray is not difficult. It is
true that oases may oooooionally arise in tfaich there may he confusion ae between early slllooale and certain forme of tuberculosis. But we should not, X think, in tiying to deal with this matter on a practical basis, be too much influenced tgr the precise and limiting terms of the laboratory research
Standards established on
basis of dust counts should be
used with extreme caution. In wr opinion, thsy have no place
whatsoever la Industrial codes. Dust counts In any Riven loca
tioa In S factory cr workshop would differ from hour to hour
and from day to day under environmental conditions that are ap
parently the same. The dust count whan done by a oompetunt
technician la a valuable help in determining whether a hasard
may be prsnt, even perhape in assessing the extent of the
hasard. The duct count cannot be set up ae an arhltrary
standard. Any itUapi to do so Is apt ta bring upon Industry
m plague of industrial odes that will involvo indantrial s-
tablisheent.s in a groat tt**l of expense and confusion.

Page 10 - The question of the progress of silicosis la open to doubt. The majority of cases do progress* The question whether such progression Is always due to added Infection baa not been determined, although the British authorities incline to the view that infaction is always responsible.
Page 15 - lour conclusions and 3, I think, would not hold if e com pensation schedule waa properly dram up. 1 refer to this later* Regardless of ehat our opinion aay be, ta are faood with the faot that sllicoela is noA compensable under a blanket lav in several of the States and that active-steps are non being taken in other States to add It to the sohoduls of occupational diseases which the Compensation law reeofnlaes, bo that it it almost certain that In the course of the next two or three years silicosis will be rathe.1 widely compensated la this country*
I si-juld Ilka to offer the following further suggestions for your coo-
alderstion, based, to a. certain extent, upon the Conclusions and recommendations;
recently arrived at by the PennoylTanla. Camwlsalofit .
.
Compensation for slliaosis should be restricted to true Sili
cosis, and should not laolude any ether related type* of
pneunonocoalosls*
',
* ''
Any act should define o111Coal* and amniarate the different stags*, thair pathology and diagnosis, preferably In the fora
outlined in the joint raport of the Connittae on Sillcool# of the American Public Health Association and the Committee
on Standarda in the compensation of occupational diaaaaaa. I enclose a jejy of this joint report *MaH hi published in 1952 In the Journal of the iiuiian Public Health Aj5ocita tion *Ill
Ill In the present state of our knowledge, I doubt if ooepmaatioa should be paid for the first stage of allioosla. Compensa tion should ba paid for saoend end third Stage silicosis or elliooils in any stage whma coaplloatwd by soilvs tuberculosis.

IV Any act filming to compensate silicosis should nrovids that la ortfjv to claim uompiuaatlQn, the claimant must have had not Iras than an aggregate q" two years' timpicyment In the 5tat#* in an industry with a recognised hesard, all 'iccurilng after the passage of the Act.,
V Host important oi all, any ailiaanifl lit must, ^-ivldo for a medical board, composed of at least three physicians with adequate knowledge and "perience, whose decision on diagnoalfl would t>e final, Jn ottinr words, It la nocraaary to get away from fin present condition of opposing sets of medical experts who sake it difficult, if not impossible, for a lay tribunal to arrive at a Just decision, I sa en closing an excerpt from the iteniiflylvania report, dealing with the medical board, which I think may b#* ox' interest to you. Please regard this as confidential until such time as the Pennsylvania report Bhaii have been given publicity.I
I had an intarestlng talk the other day with "r. Crockett. In view of what is happening In New York and other States, I da not see that industry has any recourse left except to endeuvor to get silicosis on the compensation schedule. But eny attempt at such legislation suet be thoroughly planned
