4. Hr. Haven C. Rooaevelt, Legal Counael, addreeead the meeting, and a brief eune-iary of hie romarks follow* i
" In the paet twenty-five year* variou* representatives from fry firm have outlined to you sene of the activities which you may do and which you nay not do jointly. With tho rules for these activ
ities we are all fairly faniliar. However, what you may say to each other aa opposed to what you may do together is an increasing*
ly difficult problem. In the reeent Oreeneboro case a number of competitors e^.changed infonsetion concerning price* ehorgod or
quoted to apecl.`lc customers for corrugated containers. The trial court found that each defendant had exereleed hie own judgement
with respect to taking orders and quoting pries*.
On appeal the Attomoy General argued that the exehnage of infor
mation might hav* deprived customers of some of the benefits of competition -- that absent the exchange of information a lower pries might have been quoted. The Supreme Court accepted this argument. The court drew what it called an"irr#altlbl# lnforsnes" that the exchange of information had an anticompetitive effect.
Thus It would appear that any atatistleal reporting plan having to do with recently charged or quoted prices is in Jeopardy. If this type of exchange is suspect then whet other types in the future may ineur suspicionT Although prices are th* most obvious mani festation of product competition other rectors art Important - packages; a finish, dolor or fenturo; credit; terms of sals; freight; even new products. All exchanges of information should be csr#fully examined to determine if an "irresistible Inference"
could bo drawn that customers and competition in general slight be
adversely affected."
