LABELING Of TALC PRODUCTS '
Thin will confirm ny remarks ludi at thia morning' ting:
1. Ke are currently not labeling any of cur talc product which contain between 5 and 35\ traaolite aabeatoi.
2. It la ry belief that we are In violation of the Federal Occupational Safety and Health Act aa found in Title 2, Chapter XVII, Part 1910, Occupational Safety and Health Standards, publiihed in the Federal Register, Volurc 17, No. 110, June 10, 1571. This section states in brief that any material that contains asbestcs fiber must be so labeled.
Wa should also note that within the last two months, the W. R. Grace Company has been cited in the state of Washing ton by OSHA for marketing vemiculite, which contains aimilar percentage of tremolita without proper labeling on tha bags.

Johns-Hanville should not sell talc products in situ ations where we have reason to believe that the end use will be in the cosmetic industry- Illustrative Is the case of Charles B.Chrystal Co. Inc., which we have recently learned resells the talc for the use in dusting powder or baby powder in South America and Latin America. J. Brooks and A. Finkbiner have already notified Charles B.Chrystal Co. Inc. oc this decision, which in all cases should be effective immediately.

OPTICAL AMD TL'M COUNTING OF ASBESTOS MINERALS 111 ASBESTINE 3X, ASBESTINE 325, MVTAL 2C0, AND NYTAL 400 AS CURRENTLY PRODUCED BY R. T. VANDERBILT CO.
Thank you Vlad for your very fine report covering your microscopic examination of those samples. Your data confirm analyses we havu had made on these same samples by J. P. MeGourty using X-ray diffraction techniques (Report Mo. 414-T-33) and by K. Jaunarajs using differen tial thermal analysis - primarily for the detection of serpentine mineral.
These present samples are really no different from previous

periodically over the years. Tn.oy all contain /cry sub
stantial amounts, of both tremolite and chrytotiLe and in
tvo cases substantial amounts of a third asbestos mineral,
anthcphyllits.
In numerous discussions I have had with R. T. Vanderbilt people, they have readily admitted to having trcnolice ("which is not an asbestos mineral and is not fibrous") . but they have never admitted to tne presence of either chrysotile or unthophy 11 ito. 'Lh;y do admit that years arro, when they were deliberately mining certain sections of t;;>:ir deposits for fiber, seme cf their products did contain chrysotile. This product, "Mculder.c," was sold as n direct replacement for asbestos m the manufacture of vinyl tile. I have examined "Moulder." in the-past and it was in fac. almost entirely enrysotile. "Moulaene" is no i o m c r being nade, but all cf the International Talc Company and R. T. .Vanderbilt Company talc products always have and continue to contain chrysotile as a significant nineral
component (in addition to tremolite and, ur.thophyllitc) . s.b "

It is apparent that tho R. T . Vanderbilt presentations to OSHA, NIS1I, FDA, MESA, etc. arc based on something less than tile truth. I find it difficult to believe that they could be so grossly misinformed as to what thoir materials really arc.
How this information is ultimately used is something that will have to be decided at higher levels within J-.M. However, it is my belief that R. T. Vanderbilt, with a continuance of their present methods, docs nothing but confuse the issue among the talc producers and with the various Federal agencies involved. Any properly informed person would know that they are wrong.

Mr. Howard Schulte Deputy Assistant Secretary of Labor U.S. Department of Labor Occupational Safety and Health
Administration Washington, D.C. 20210
Dear Mr. Schulte:
Our meeting on Wednesday, January 29, was most helpful to me and the other Johns-.Manville representatives present. The question of what caution label is required for talc products containing asbestos is an important one for JohnsManville and is one which V7e believe should be quickly resolved by the Occupational Safety and Health Administration.
Johns-Manville will continue to label its talc products with both the regulated asbestos caution label and a caution as to the inhalation of talc dust. We feel it is imperative that persons occupationally exposed to these products be warned of the potential hazards.
We are convinced that the question of what a fiber is should be subordinated to the question of what harm is likely to be caused by the particle involved. While proceeding to eliminate the semantic confusion which exists, we believe the Administration should move quickly to sample the talc products now being marketed and determine whether caution labels are required under existing regulations. Such sampling will reveal, we believe, excessive levels of tremolite fibers and chrysotile fibers in some products not now being labeled with the asbestos caution.
Prompt action by the Administration is essential to the well-being of hundreds of workers in the talc, paper and paint industries and other users of talc products containing asbestos.
Mr. Howard Schulte
