v Asbeetosis Claim
Vhen the settlem ent figure o f over $5000 i s compared to the length of time the decedent worked fo r your company, the o u t-of-court settlem ent seems extravagant. When compared to th e p o te n tia l, however, i t appears
th a t a reasonable settlem ent was effected.
Vith regard to the l a s t employer being held responsible fo r the f u ll aaount o f th e award, the Commerce Clearing House Infom ation Service on Workman* s Compensation, to which vs subscribe, l i s t s sevsral eases in which th is was held to be the case. This i s not peculiar to Massa chusetts since we know o f several o th er s ta te s where the l a s t employer . was also held to be solely responsible fo r the award. In some of the s ta te s , however, an apportionment proceeding i s perm itted 'hereby former employers and/or th e ir insurance c a rrie rs are held responsible fo r a
p a rt o f th e to ta l award, which p a rt l a usually based upon the length o f time the claimant was amplcyed and in actual oontaet with the con
d itio n which caused the disease. Ve do not know i f an apportionment
proceeding i s permitted in Massachusetts.
I f additional precautions oould be taken a t the time o f employment, your workmen*! compensation costs and future ra te s would certainly
show the fdvorable re s u lts o f these measures.
Sincerely yours,

Dear Jin :
`
On February 3rd, we received a coaanunlcatioc fro fte Commonwealth^ uf yiini<im iniiieljt' iMTl1nn nf !ir1" 1 iwMHent, dated January 31. 19gfl, ind^ca t i p g t h a t ^ Ee Above-um *; was a n ^ T C o v e re r and who
r ^ r i e f t e n b e r 1 7 . 1V>7 to Ibvember M, 1957, had an
\ o A dent on the job. *e had no record of any accident end our foreman ^JcltS iT T K at^ aie was reported to him. On February U, 1958, upon rece ip t of the communication, Frank Sherman mailed in an accident report form giving the man's name and address and o th ^ g ^ ta tia ^ io s, and quoted as follows: "This man was employed by as from yeeruayy 17, 1957 to November U, 1957........ have no record of any accident on job...w as applying Pipe Covering and Block a t job (Mystic S tatio n , Boston Edison Company)*.
A few days ago, when I was out of the o ffic e , Mr. Giroux of the Division of In d u stria l Accidents, Comonwealth of Massachusetts, 18 Tremont S t., Boston, called a t the o ffice and advised Frank Sherman th at Jam s Shepard had died, apparently e f some lung disorder and th at "his wife intended to sue the Armstrong Cork Company claiming th at the cause of death was
the re s u lt of h is working fo r the Armstrong Cork Company. "
James Shepard was a P lasterer working on a permit as a Pipe C0verer and probably spent a minor p a rt of h is working l i f e as a Pipe Coverer. Of course i t is quite obvious th a t in working fo r us fo r a period of only seven weeks, he oould hardly have contracted anything in th is length of time which could have resu lted in his death. We believe that we are his la s t Employer and Mr. Giroux to ld Frank Sherman th a t th is was probably why his wife was bringing action against the Armstrong Cork Company. Tou w ill note th a t the time during which he worked for ua, he was in the employ of the Armstrong Cork Company, not the Armstrong Contracting and
