A provisional agreement was reached on the revised Regulation on 5 October 2023. Subject to the formal endorsement of the new Regulation by co-legislators, the new rules could become applicable early 2024. Following discussions with the Commission legal service, considering the envisaged new rules for the establishment of reference values for the years 2025 and onwards, it is more appropriate that the draft implementing act establishes reference values for the year 2024 only. Such an approach is fully in line with Article 16(1) of the Regulation and avoids creating ambiguous expectations from undertakings about the establishment of their future reference values. In this light, we proposed the necessary changes to the draft implementing act (attached). The annex to the draft implementing act has been uploaded in CIRCABC due to its confidential nature (only change introduced is in the title). We underline that the proposed changes do not affect neither the list of beneficiaries of reference values nor the values for the year 2024, as presented at the Committee meeting. The changes only concern the deletion of the reference values for the years 2025 and 2026. 1 We would therefore like to submit the amended draft act for vote by written procedure, pursuant to Article 8 of the Rules of Procedure of the Committee.
