The goal of this newsletter is to keep you informed about asbestos and government regulations, developments in handling asbestos within user industries, and to provide factual information about all phases of asbestos. Just drop us a note! ASBESTOS - WHAT IS IT? Asbestos is a generic term for a group of hydrated silicate minerals that have found broad use in today's industrial world. It should be noted that these minerals are divided into two dis tinct groups on the basis of their crystalline structure: serpentine asbestos and amphibole asbestos. The serpentine category consist's only of chrysotile asbestos while the amphibole group includes: crocidilite, amosite, anthophyllite, tremolite, and actinolite. Johns-Manville mines and markets only chrysotile fiber, the variety of asbestos most widely used in the United States. Chrysotile is a hydrous magnesium silicate which exists in the form of bundles of flexible silky fibers. Its unique properties have led to its use over hundreds of years in products such as textiles for clothing; durable, safe building products; brake linings; flooring; pipe; paper; paint; and numerous other applications. Recent publicity has contained both fact and fiction as to the propriety of using asbestos and through this newsletter we will attempt to keep you abreast of the latest factual information. OSHA AND EPA REGULATIONS The two major government bodies regulating asbestos use are the Labor Department's Occupational Safety and Health Administra tion (OSHA), and the Environmental Protection Agency (EPA). OSHA's primary function is the promulgation and enforcement of safety and health standards, and its interests with respect to asbestos lie with the working conditions in and around an asbestos using operation. OSHA regulations concerning asbestos are published in the June 7, 1972, Federal Register Section 1910.93a. The EPA's function is directed toward implementation and en forcement of the Clean Air Act and the Water Pollution Control Act. EPA is concerned with asbestos emissions from only certain manufacturing operations, and its regulations are published in the August 6, 1973, Federal Register Volume 38, Number 66, Part II. These regulations are readily available from your regional EPA office. For your convenience a summary of the regulations and a list of EPA offices is attached. Pipeline Protection Johns-Manville Asbestos Fiber Sales Greenwood Plaza-Denver, Colo. 80217-(303) 770-1000 EPA UPDATE On May 3, 1974 EPA published an amendment to the National Emission Standards for Hazardous Air Pollutants in the Federal Register. We have included a copy of the amendment with this newsletter. The revisions are designed to clarify and define statements in the original regulations. Basically the definitions are as follows: ASBESTOS MILL: Any facility engaged in the conversion or any intermediate step in the conversion of asbestos ore into commercial asbestos. Open storage areas and asbestos tailings piles are specifically exempted. COMMERCIAL ASBESTOS: ' Any variety of asbestos produced, by extracting asbestos from asbestos ore. MANUFACTURING: Applies only to those sources within the categories of affected manufacturing facilities specified in the April 6, 1973 regulations that process commercial asbestos into a product. ' DEMOLITION: Defined as the wrecking or removal of any load supporting struct ural member. It does not apply to remodeling or renovation where structural members are not removed. The revisions have been published to advise the public of how EPA is interpreting the regulations. FIBER HANDLING - THE KEY TO SAFE WORKING CONDITIONS OSHA standards were designed to assure workers of safe and healthful working conditons. To assist fiber users in meeting these standards, J-M has developed and is developing packaging and fiber handling techniques to eliminate or limit dust problems. J-M has devel oped packages such as the pulpable paper bag which can be dumped, un opened, into the hydropulper or similar mixer. This package limits a worker's exposure to fiber dust and has gained wide acceptance in the paper industry. It lends itself to any wet system with high intensity mixers. Polyethylene bags are being used in the floor tile and asphalt paving industries where they can be added to the mixer without being opened. The bags melt at 250 F and become a part of the mix. The success of these packages depends on the bags being delivered to your plant in a damage-free state. To assist in accomplishing this, J-M has developed systems such as palletized units, shrink wrapping with polyethylene, and the assigned rail car. The assigned car system utilizes rail cars assigned solely for the customers use, palletized units of bagged fiber and inflatable dunnage to stabilize the load. There is a charge for each pallet and dunnage bag with a partial credit for pallets and full credit for dunnage bags when'they arereturned in the assigned cars. Pellets have been produced with Group 6 & 7 fiber at our Jeffrey Mine and experimental quantities are available on request. The pellets normally contain 10-12% moisture but can be dried to 2% moisture if necessary. The concept of pellets lends itself to bulk shipments in hopper cars, but our program will evaluate bagged pellets and also packaging in 2-^m^^per" bags. Many people hesitate to contact OSHA for free advice...and right fully so. Once an OSHA inspector visits a work place, he is obligated to make an inspection and recommend penalties for unlawful working conditions. But there is an arm of the federal government that can and does offer free consultation and advice especially for the small company. The National Institute of Occupational Safety and Health (NIOSH) a part of the Department of Health, Education, and Welfare provides numerous services that will assist an employer in eliminating hazardous working conditions. These short courses, usually 5 days in length, are taught by experienc ed professionals and cover occupational safety and health, occupational hazards, industrial hygiene, sampling and evaluating airborne asbestos dust, and numerous other subjects. Sincerely, PRODUCE July 11, 1974 RECENT DEVELOPMENTS REVISED OSHA ASBESTOS STANDARD As you know, the Occupational Safety and Health Administration, U. S. Department of Labor, is planning to revise the present asbestos standard. It is our belief they decided to do this because the Industrial Union Department, AFL-CIO filed suit against the Secretary of Labor petitioning for reconsideration of seven sections of the standard. The basic claim of the suit -- that the standard was inadequate to properly protect the health of workers exposed to asbestos. In our first discussions with OSHA personnel concerning their future actions, we formed the opinion that they would prepare a major revision or complete rewrite of the present standard. ' On April 15, 1974, the Circuit Court of Appeals rendered its decision on the IUD lawsuit. The decision was basically favorable to the Department of Labor, since it denied all but two issues. These two, which were remanded to the Secretary of Labor for further considera tion, are: (1) The uniform application of the 1976 effective date for the two fiber asbestos standard. (2) The three year retention period for records of exposure levels detected by monitoring the work place . The Appeals Court's decision presently is being studied by the Solicitor General's office who in turn will re commend to the Secretary of Labor the course of action he should follow. This recommendation has not as yet been received by the Secretary. However, in discussing the Court's decision with people in the Division of Health Standards who are responsible for preparation of the revised asbestos standard, we have concluded that it has changed their thinking. The apparent preference now is to amend the present standard, including rewording and addition of new sections; but not to do a major revision or complete rewrite. We believe that prior to the court decision OSHA had been thinking of a new standard written around work practices. This has now changed. While OSHA officials still want industry to submit suggested work practices for inclusion in the amended standard, the scope and effective thrust of the work practices section will be lessened. A1so,mA| Page 2 OSHA is now putting more emphasis on industry comment concerning the problems of the present standard and suggestions for rewording and amendment. The asbestos industry input is being provided by the Standards & Technical Committee of the Asbestos Information Association/North America, consisting of 13 members under chairmanship of E. M. Fenner of Johns-Manville. They expect to complete their input on work practices and other areas by July 15 and, at the present time, are not able to estimate when OSHA will issue a new proposed standard for asbestos. In order to provide you with greater detail on the subject, we are attaching comments from the April 22 and April 25 issues of the Occupational Safety and Health Reporter. Concerning the two items remanded by the court to the Secretary of Labor, it is our opinion: (1) that the effective date of the 2 fiber standard will not change, and that staggered implementation dates will not be utilized. (2) that the retention period for monitoring records will increase - possibly to twenty years. E.M. The J-M Environmental Affairs Department has been follow ing this subject closely and we are attaching a copy of ? their latest report on recent developments. It now appears OSHA regulations will be amended where necess ary rather than completely revised. The text of Fire-Safe Curtains this surprise revision is contained in The Federal Register, Vol. 40, No. 197 -- Thursday, October 9, 1975. ISasricalTy-' the proposed standard would institute the following changes in the current regulations: 1) Lower the permissible exposure level to 0.5 fibers/cc Highway Safety from the current level of 5 fibers/cc and the July 1, 1976 level of 2 fibers/cc. 2) Lower the permissible ceiling concentration to 5 fibers/cc from the current 10 fibers/cc. 3) Extend the record retention period for medical and monitoring records to 40 years or the duration of employment plus 20 years whichever is longer. The current standard requires retention of medical records for 20 years and the monitoring records for 3 years. 4) Require specific minimum data on medical and monitor Passenger Car Safety ing records. 5) Revise the procedures for initial and subsequent monitoring. WHAT SHOULD YOU DO As one of the major producers and users of asbestos, Johns-Manville has formed a task force to study the new proposal and develop medical, legal, and feasibility and economic impact information in order to pre pare our comments on the issues raised by these regulations. Obviously, it will not be possible for J-M to provide technical assistance on this subject to all of its customers. As an alternative we plan to provide the information we develop to the Asbestos Information Association/North America -- (A.I.A./N.A.). The A.I.A./N.A. was formed in December 1970 to coordinate the efforts of the asbestos industry in disseminating authoritative information concerning asbestos and the asbestos industry with emphasis on the safety, health, and environmental issues. Currently, it consists of twenty-two asbestos companies in the U.S. and Canada. The objectives of the Association are: 1) To provide industry-wide information on asbestos and health, and on industry efforts to eliminate existing hazards. 2) To cooperate with governmental agencies in developing and imple menting industry-wide standards for worker protection and for the control of asbestos dust emissions into the community air and water. 3) To exchange information on methods and technique.s-of'asbestos dust control. 4) To correct misleading and uninformed reportage on asbestos/health problems. 5) To publicize the unique benefits and importance of asbestos product and otherwise represent the asbestos industry. A.I.A./N.A. has also retained a medical consultant. Dr. Hans Weill, who will oversee the development and collation of perti nent medical information on asbestos. This information will be available for the benefit of its members. The OSHA proposal requests written comments, data and arguments from interested persons on or before December 8, 1975. It also states that an informal hearing may be requested to provide further opportunity for discussion of the issues. Both.J-M and the A.I.A./N.A. have requested an extension of 120 days from the December 8, 1975 date for filing objections in order to allow proper preparation of our comments. We also plan to request a hearing. WHO SHOULD COMMENT? EVERYONE concerned with the use of asbestos should be prepared and plan to comment on the issues raised by the proposed regulations. Your comments should address the issues of medical, feasibility and economic impact. The major users are preparing their comments on these issues. However, included in the proposed regulations is a concern regarding the affect they will have on those employers who have a relatively small (More) produced I#. number of employees. It is obvious that OSHA is requesting that these users, especially, come forward and present their comments. We urge you to request a hearing in order to present your comments and arguments. Comments should be factual and representative of a sensible rather than emotional approach to the subject. The problem as described in the accompanying brochures Asbestos and Health and Questions and Answers on Asbestos and Health is an occupational problem that can be readily corrected by maintain ing proper working conditions. Many of the medical figures being published today repre sent a working population of 30 or 40 years ago who were exposed to heavy dust concentrations. More recent medical evidence indicates that with today's improved dust control measures there is every reason to believe that the incidence of asbestos related disease will decrease. We strongly suggest that you read through Asbestos and Health and Questions and Answers on Asbestos and Health. Additional copies are avail able from Johns-Manville. ASBESTOS - THE FUTURE The obvious question of all asbestos users is "Can we continue to use asbestos safely within the new regulations?" The answer is ... YES. To this end, Johns-Manville has developed and continues to develop fiber handling methods which will limit a worker's exposure to dust. Future news letters will cover these methods.
