Monsanto Company Dear Mr. Skrinjaric: The purpose of this letter is to advise you of a prior, completed representation by our Chicago office of Nevada Power. The representation was completed last year and it did not involve PCBs or any type of equipment involved in the current litigation. This law firm has never had any ongoing relationship with Nevada Power and never before represented Nevada Power. In May, 1988, an attorney from Beckley, Singleton, DeLaney, Jamison & List of Las Vegas requested that the Chicago office of Kirkland & Ellis act as local counsel in a discovery dispute. Beckley, Singleton represented Nevada Power in a Nevada state court case against several contractors who built the cooling towers for the Reed Gardner #4 power plant. The dispute at issue involved the discoverability of the work product of a consultant to Nevada Power located in Illinois. Our representation of Nevada Power ended in November, 1988. No attorney from Kirkland apparently had contact with Nevada Power employees during this representation. Kirkland & Ellis was retained by Beckley, Singleton and submitted its bills directly to that firm. Kirkland & Ellis has never worked on any matter for Nevada Power that relates to PCBs or the electrical equipment involved in the current lawsuit. Page 2 KIRKLAND 8.
