'Placing on the market' means placing on the market as defined in point 12 of Article 3 of Regulation (EC) No 1907/2006 and import shall be deemed to be placing on the market. FYI, the first subparagraph of article 4.2 states that an article containing a substance listed in Annex I or II to the POPs Regulation produced before or on the date of applicability of such listing is exempted from the restrictions laid down in Article 3 of that Regulation for a non-renewable six-months period counting from the first day of application of the POPs Regulation to that substance. The second subparagraph states that the provisions laid down in Article 3 of the POPs Regulation do not apply to articles already in use at the date of the entry into application of the listing of the substance. An article is "in use" when it is in possession of the final user (i.e a consumer or professional user) or when it has started being processed into another product. In addition, although the provisions of the first and second subparagraphs of Article 4(2) do not specifically refer to the articles produced in the Union or the articles in use in the Union, they should be interpreted in line with the Stockholm Convention (i.e notes (ii) to Annexes A and B) and refer to the articles produced in the Union and articles in use in the Union containing restricted substances. The articles to which you refer (i.e rugzakken gemaakt voor het leger) were neither produced nor "in use" on the date of the entry into application of the listing of PFOA (i.e 4 July 2020). Consequently, the first and second subparagraph of article 4.2 do not apply to the case described. Artikel 4.2 van deze verordening stelt tevens dat: "Artikel 3 is gedurende een periode van zes maanden niet van toepassing op stoffen die na 15 juli 2019 in bijlage I of II zijn opgenomen en voorkomen in voorwerpen die vr of op de datum waarop deze verordening op die stoffen van toepassing wordt, zijn geproduceerd." Een lidbedrijf heeft in maart 2022 een bepaalde hoeveelheid weefsel dat met PFOA werd behandeld geleverd aan zijn klant. Deze klant heeft nog nu nog een resthoeveelheid over (+/- 500 Ipm) en stelt zich de vraag of rekening houdende met artikel 4.2 hiermee nog rugzakken gemaakt kunnen worden voor het leger. De levering zou nog gebeuren voor 4 januari 2024, dus binnen de 6 maand nadat het verbod voor deze toepassing van kracht werd. Volgens onze interpretatie zou dit nog mogelijk zijn, maar we willen dit graag nog even aftoetsen met uw diensten. Alvast bedankt voor uw reactie. Met vriendelijke groeten, 2
