Environmental Protection Agency Region 4 Air Enforcement Branch 61 Forsyth Street, SW Atlanta, Georgia 30303 INSPECTION REPORT Facility Inspected Williamson Brothers Bar-B-Q 1600 Marietta Highway Canton, Georgia 30114 Inspection Date: December 14, 2022 Facility Programmatic ID 0400000013057EPA25 LAT: 34.2244 LON: -84.5014 Inspection Type Clean Air Act (CAA) National Emission Standards for Hazardous Air Pollutants (NESHAP) - Asbestos Inspector Pamela Storm Introduction An inspection pursuant to Section 114 of the CAA was conducted on December 14, 2022, at Williamson Brothers Bar-B-Q located at 1600 Marietta Highway in Canton, Georgia 30114 (the facility). The unannounced inspection was conducted by Pamela Storm who possesses EPA inspector credentials to conduct CAA NESHAP asbestos inspections. The facility is a restaurant. Permits #D2210-059 (demolition - interior gutting) and #R02211-023 (other renovations) were obtained from the City of Canton by Latimer Construction Company, Inc. on October 28, 2022 and November 8, 2022, respectively. A kitchen fire occurred at the facility on October 23, 2022. The demolition permit was obtained for "removing interior damage" and "interior gutting" of the facility. This permit stated that approximately 10,700 square feet of damaged building materials were to be removed. The "other renovations" permit stated that it was obtained for the interior finishing of the facility or "replacing what was there" prior to the fire. Renovations had been ongoing at the time of this inspection. The purpose of the inspection was to determine compliance with the CAA NESHAP Asbestos Standard and the regulations promulgated at 40 CFR Part 61, Subpart M, for the renovation activities conducted pursuant to these permits. The EPA Region 4 CAA NESHAP asbestos program targets facilities for inspection located in the State of Georgia based on tips/complaints; permits issued on a local level; and demolition and/or renovation/abatement notices sent to the State. This inspection was conducted based on the previously mentioned permits. Facility Information The facility is a restaurant. Inspection Inspection CAA Asbestos Inspection Report: Inspection Date: Williamson Brothers Bar-B-Q 1600 Marietta Highway Canton, GA 30114 12/14/2022 Page 1 of 2 Upon arrival at the facility, the EPA inspector met with Reyes Morales, the facility owner. The inspector presented her inspector credentials and explained that EPA was conducting the routine oversight inspection of the permitted renovation activity for compliance with the Asbestos NESHAP. Reyes Morales explained that the facility was in the process of being renovated by "his workers" to remove and replace facility building materials and facility components which were damaged in a kitchen fire at the facility which occurred on October 23, 2022. Reyes Morales stated that Toby Latimer with Latimer Construction Company, Inc. obtained the necessary permits from the City of Canton prior to the renovation of the facility by workers hired by Reyes Morales. Reyes Morales explained that his workers had removed damaged walls, ceilings, window frames and kitchen ovens and equipment. Reyes Morales added that Fritts Heating and Air had removed some damaged piping from the facility. Some foil-wrapped piping materials removed from the facility were visible in a pile behind the facility. Fritts Heating and Air trucks were parked in the facility's parking lot. Workers were on ladders doing work on the facility's ceiling materials. Reyes Morales said that no asbestos inspections were performed at the facility prior to the removal of the damaged facility's building materials and facility components. Reyes Morales was not aware of any requirement for such inspections prior to renovations and stated that he had been working with the City of Canton which did not inform him of any such requirement. The EPA inspector explained the thorough inspection requirement contained in 40 C.F.R. Section 61.145(a) of the Asbestos NESHAP and provided a synopsis of the Asbestos NESHAP requirements as well as her contact information. Renovation activity had been ongoing at the facility at the time of this inspection. Conclusion The EPA inspector will follow up with the owners/operators of the facility and the renovation activity, as deemed appropriate, to obtain information and necessary paperwork related to this renovation activity. This information will include, but not necessarily be limited to, copies of asbestos inspection reports, renovation notifications, and waste shipment records for the facility.
