Dear Sirs, Agfeaatosla Wo have received your letter dated 1st April and would advise you first of all that claims now arising in respect of asbesto3is are made on the State in accordance with the National Insurance (Industrial Injuries) Act, 19ko which came into operation on the 5th July 19I+8. Prior to the 5th July 191+0 the procedure was laid down by Government Regulations known a3 the "Silicosis and Asbestosis (Medical Arrangements) Scheme, 1931" and wo f e d we cannot do bettor than quote from these Regulations dealing with the Right to Compensation; this extract is attached. - ou will notice from the attached extract that the paragraph narked 5 is apparently the one in the minds of tho employer^ representatives, mentioned in the third paragraph of your lottor. At the beginning of paragraph 3 of your lottor you refer to the question a3 to how long an onployeo should have been exposed to dust inhalation before ho can make a claim. You will see from tho Regulations enclosed that thoro has never been any tino limit in this country; in other words, an employee wa3 always at liborty to claim compensation but tho Government Regulations defined certain circumstances (see (a), (b) and (c) of tho extract) undor which compensation would not bo payable. Dear Sirs, Asbestosis - t . We are referring to our exchange of letters of Februa ri 1952 on thi3 subject. A medical committee appointed by the Ministry of Labour are presently elaborating in this country rules to apply to employees in their claims for compensation. One point only is difficult to settle viz. how long v an employee should have been exposed to dust inhalation be fore he can file a petition. While the employer's representa tives in the committee suggest five years for this, which is provided by the french regulations, several members are recon mending one year, which we believe to be far too low from both a practical and psychological point of view.
