We have determined that some of the requested records can be released. At this time, we are providing a 2nd interim response to your request. However, after carefully reviewing all requested records with an eye toward disclosure, we were unable to provide you with portions of these documents which have been determined to be exempt from mandatory disclosure by virtue of Exemptions 4 and 6 of the FOIA. See 5 U.S.C. 552(b)(4) and (6). Exemption 4 requires the Agency to initially withhold trade secrets and commercial or financial information obtained from a company that is privileged or confidential. Exemption 6 protects information about individuals in "personnel and medical files and similar files" when the disclosure of such information "would constitute a clearly unwarranted invasion of personal privacy." Your request is not being closed at this time.
