The Order requires the My Place Mobile Home Park (Respondent) to comply with the provisions set forth in the attached Order. The EPA requests that the Respondent immediately confirm receipt of this Order by a response e-mail to shaikh.fatima@epa.gov. As an owner/operator of a PWS and as a supplier of water, the Respondent is required to comply with the Safe Drinking Water Act (SOWA) and the National Primary Drinking Water Regulations (NPDWRs). My Place Mobile Home Park was notified of the identified deficiencies and instructed to correct the deficiencies by December 23, 2022. My Place Mobile Home Park violated 40 C.F.R. 141.403 by failing to address the significant deficiencies and 40 C.F.R. 141.401 by failing to make public notice of these deficiencies. Additionally, My Place Mobile Home Park failed to monitor for lead and copper during the June 1 through September 30, 2023, monitoring period. My Place Mobile Home Park violated 40 C.F.R. 141.86 by failing to conduct routine tap monitoring for lead and copper. EPA issued a Notice of Noncompliance (NON) to the Respondent on May 22, 2024. This Order does not assess a monetary penalty; however, it does require compliance with the Ground Water Rule and Lead and Copper Rule pursuant to 40 C.F.R Part 141.401, 141.403, 141.86. The Administrator delegated the authority to issue this Order to the Regional Administrator of EPA Region 6, who delegated such authority to the Director of the Enforcement and Compliance Assurance Division. FINDINGS 1. The My Place Mobile Home Park (Respondent) is a person, as defined by Section 1401(12) of the Act, 42 U.S.C. 300f(12). 2. At all times relevant to the violations alleged herein (relevant time period), Respondent owned or operated a public water system (PWS), as defined by Section 1401(4) of the Act, 42 U.S.C. 300f(4), located in Breaux Bridge, St. Martin Parish, Louisiana (facility), designated as PWS Identification Number LA1099025, and known as the My Place Mobile Home Park. 3. During the relevant time period, Respondent's PWS served as a "community water system", as defined by Section 1401(15) of the Act, 42 U.S.C. 300f(15) and is subject to the requirements of the Act, 42 U.S.C. 300g-l, and its implementing regulations, 40 C.F.R. During the relevant time period, Respondent's PWS was subject to the requirements of the National Primary Drinking Water Regulations (NPDWR) including the Ground Water Rule (GWR) as set forth in 40 C.F.R. 141.401, 141.403. 5. During the relevant time period, Respondent's PWS was subject to the requirements of the National Primary Drinking Water Regulations (NPDWR) including the Lead and Copper Rule (LCR) as set forth in 40 C.F.R. 141.86. 6. The Louisiana Department of Health (LOH) administers the Public Water Supply Supervision Program in Louisiana pursuant to Section 1413 of the SOWA, 42 U.S.C. 300g-2. LOH has primacy for the NPDWR and has primary enforcement responsibility for the GWR and LCR. LOH referred this system to EPA for enforcement on February 15, 2024. 7. Pursuant to 40 C.F.R. 141.202, Respondent must provide notice to the public of significant deficiencies identified by the state. 8. Pursuant to 40 C.F.R. 141.403 Respondent must complete corrective action of significant deficiencies identified by the state in accordance with applicable State plan review processes. 9. Pursuant to 40 C.F.R. 141.86, all water systems must sample for lead and copper at taps used to provide water for human consumption in accordance with the requirements. 10. Respondent violated 40 C.F.R. 141.202 by failing to correct significant deficiencies identified during a sanitary survey and failed to make public notice of these deficiencies. 11. Respondent violated 40 C.F.R. 141.403 by failing to address the significant deficiencies. 12. Respondent violated 40 C.F.R. 141.86 by failing to conduct routine tap monitoring for lead and copper during the June 1 through September 30, 2023, monitoring period. 13. LOH issued notice of violation letters to the Respondent on January 24, 2023, and November 6, 2023, for the violations of the GWR and LCR. On May 22, 2024, pursuant to Section 1414(a){l){A) of the SDWA, 42 U.S.C. 300g-3(a)(l)(A), EPA issued a Notice of Noncompliance (NON) to Respondent due to its noncompliance with the GWR and LCR and sent notice of NON's issuance to LDH. EPA also provided notice to an appropriate local elected official with jurisdiction over the PWS of the NON. 15. Pursuant to Section 1414(g)(2) of the SDWA, 42 U.S.C. 300g-3(g)(2), EPA conferred with LDH regarding this Order. SECTION 1414(g) COMPLIANCE ORDER Based on these findings and pursuant to the authority of Section 1414(g) of the Act, 42 U.S.C. 300g-3(g), EPA orders that Respondent immediately take the following actions: A. Within thirty {30} days of receipt of this Order, Respondent shall address the significant deficiencies identified, provide notice to the public of identified significant deficiencies, notify all customers of the non-compliance by direct mail or hand delivery and by publishing the notice in a general circulation newspaper serving the area. B. This Section 1414(g) Order does not constitute a waiver, suspension, or modification of the requirements of 40 C.F.R. Part 141 or other applicable federal and state requirements, which remain in full force and effect. Issuance of this Section 1414(g) Compliance Order is not an election by EPA to forego any civil or any criminal action otherwise authorized under the Act. Violation of any term of this Section 1414(g) Order may subject Respondent to an administrative civil penalty under Section 1414(g) of the Act, 42 U.S.C. 300g-3(g), or a civil penalty, assessed by an appropriate United States District Court under Section 1414(g)(3)(A) of the Act, 42 U.S.C. 300g3(g)(3)(A). This Order shall be binding on the PWS cited herein and all its successors and assignees. No change in ownership of the PWS shall alter the responsibility of the PWS under this Order. For purposes of the identification requirement in Section 162(f)(2)(A)(ii) of the Internal Revenue Code, 26 U.S.C. 162(f)(2)(A)(ii), and 26 C.F.R. 1.162-21(b)(2), performance of Paragraph A in Section 1414(g) Compliance Order is restitution, remediation, or required to come into compliance with the law.
