Belden, Suite 1, Chicago, Illinois 60647 Defendant, Sears, Roebuck and Co. (hereinafter "Sears"), through its attorneys Segal, McCambridge, Singer & Mahoney, Ltd., responds to Plaintiffs' Interrogatories as follows: PREAMBLE AND GENERAL OBJECTIONS Sears, Roebuck and Co. does not now mine, mill, manufacture, process or distribute wholesale and has never mined, manufactured, processed or distributed wholesale asbestoscontaining products as those terms are commonly used and understood in this litigation. Sears at all relevant times is and has been a retailer of various customer products and services, and at certain times and at certain places, may have sold asbestos-containing products manufactured and/or distributed by others. As such, Sears ability to answer these interrogatories is limited by this role. Further, these interrogatories seek information that is extremely broad and burdensome given the l INTERROGATORIES 1. State whether defendant ever manufactured, mined, sold, installed, or otherwise placed asbestos or asbestos-containing products or equipment into the stream of commerce, and ifso, state: (a) the name of the corporation.or entity engaged in such activity; (b) the specific activity or activities involved; (c) the dates each entity was involved; (d) the relationship between defendant and each entity: (e) the dates your relationship with each entity ended; and, (f) if applicable, state the manner by which each such entity was acquired by you. ANSWER: Defendant objects to this Interrogatory as it is overly broad, unduly burdensome, irrelevant and not reasonably calculated to lead to the discovery of admissible evidence. However, without waiver, Defendant states as follows: As far as the products at issue in this matter (Joint Cement for Dry Wall, Ready-Mixed Joint Cement, Patching Plaster and Spackling Paste) and the time period plaintiffs alleged to have purchased these products (1964 through 1979), Defendant states that it sold such products at various times between 1964 and 1974, however, based on its investigation as of this date, has no information that these products contained asbestos. See Defendant's Response to Request for Admissions. 3 (e) a complete description of any such equipment supplied to any of the job sites listed in the definitions above; (f) a description of the asbestos or asbestos containing products required for the equipment, including specifications, brand and trade names. ANSWER: Defendant objects to this interrogatory as irrelevant. The allegations against Sears in this matter do not pertain to equipment. s 4. If defendant at any time mined, manufactured, installed and/or sold asbestos or asbestos containing products then state the following: (a) the brand names of each such product and the years manufactured and sold; (b) a description ofthe physical and chemical composition of each product including the type of asbestos contained in each such product and the percentage of each type of asbestos in each product; (c) a description ofthe physical appearances of each such product, including its color and texture; (d) the form and sizes in which the product was sold, e.g. powder, half-rounds, flats, etc; dimensions; (e) the type of packages, e.g., bags, boxes, cans, in which the product was sold or distributed, a physical description thereof, and a description of any printed material, 5 trademark, insignia, or corporate logo that appeared thereon. Please annex hereto a photo or copy of each logo so described; (f) a detailed description of the intended uses of each such product; and. (g) ifany warnings or instructions concerning the possibility ofinjury or disease were ever affixed to or distributed with the products, then set forth the following information: 1. the brand and trade name of each such product that contained a warning or instruction; 2. the date a warning or instruction was first attached to or distributed with each such product; 3. the method used to distribute the warning or instruction to persons likely to use the product, 4. the exact wording of each warning or instruction; 5. please annex hereto copies of each such warning or instruction. ANSWER: Defendant objects to this Interrogatory as overly broad, unduly burdensome, irrelevant and not reasonably calculated to lead to the discovery of admissible evidence. However, without waiver. Defendant states as follows: (a) See response to No. 1 and Response to Request For Admissions. Defendant does not have a list of all merchandise sold through its retail outlets from 1964 through 1979, however, it has searched its general catalogs for Chicago Fall/Winter and 6 Spring/Summer for the products at issue in this matter and has found that none of these products were sold through the catalog after 1974. For the period 1964 through 1974, Defendant attaches the catalog pages, which advertise Joint Cement for Dry Wall, Ready Mixed Joint Cement, Patching Plaster and Spackling Paste as Exhibit 1. These catalog products set forth a description of each product and its packaging, as well as identify which years each product was sold. Defendant has no information available regarding the composition of these products, other then the catalog references. Investigation continues. (b) See response to No. 4(a). (c) See response to No. 4(a) and Exhibit 1. Defendant is no longer in possession of these products and therefore is unable to answer more fully at this time. Investigation continues. Has the defendant, ever sold, distributed, constructed, installed, repaired, or maintained either directly or indirectly, any asbestos products or any equipment to or at the work sites listed in the definitions above? ANSWER: 7 11. Were any studies or tests conducted on the defendant's asbestos containing products or equipments determine any potential health hazards involved in their use? Ifso: (a) identify each individual who conducted such studies or tests; (b) describe the nature, manner, method and result of each study or test (c) identify and affix to your answer copies of all reports of the results of such tests or studies. ANSWER: Sears objects to this interrogatory as overly broad, but consistent with the objections and limitations set out in the Preamble and General Objections, and based on information currently available and reviewed as of this time, and without waiver, Sears has no information that any studies or tests were conducted on any of the products at issue (Joint Cement for Drywall, Patching Plaster, and Ready Mixed Joint Cement and Spackling Paste) identified by plaintiffs in the First Amended Complaint and discovery responses.
