LAA]KE, Referee J u l y 1, I 960 Injury* Asbestosis REPORT OF REFEREE The original application was filed herein by the employee That claim was taken off calendar August 8, 1953# because of the death of the employee# Thereafter# certain lien claims were filed herein and the sister and brother-in-law of the deceased filed a claim for reimbursement of medical expense incurred on behalf of the deceased The matter came on for hearing on June 13# I960, at which time the lien claimants appeared through counsel (Smith & Parrish# by John B. lewis)* Testimony was taken as set forth in the Report of Referee dated June 13# i960* a copy of which Is attached hereto and is hereby made a part of this report* Thereafter, a notice of intention to submit the case issued in accordance with the understanding arrived at the hearing that such a notice would issue and would be served by the Industrial Accident Commission upon Blue Cross at its San Francisco address* This was done* No objection to sub mission has been received within the time provided# or at all# and tv matter is now submitted for decision* Notice of submission included notice that upon submission decision would i33us to the effect that Robert Zinl suffered no industrial injury in his employment and that he required no medical treatment to cure or relieve from any industrial injury. The reason for this rather unusual proceeding was that the parties present were mindful of the state of the medical evidence) in particular, that Zinl died as the r e s u l t of a carcinoma of the lung* (Certificate of death dated August 20# 1959# filed as a part of defendant State Compensation Insurance Fund*a Exhibit No. 1.) T h at, how ever, s in c e Mr. Z i n i 's d e a th he has made ex ten siv e re se a rc h in th e l i t e r a t u r e concerning connection between carcinoma and a s b e s to s is and th a t he fin d s th e re i s a "su g g e stib le re la tio n s h ip " between a s b e s to s is and carcinom a in th e l i t e r a t u r e . In th is connection w itness m entions th a t th e in cidence of carcinoma in asb esto s workers has been found to be h ig h er than the average fo r th e community, t h a t in Germany a s b e s to s is i s a com pensable d is e a s e b u t t h a t a s to Mr. Z in i th e r e a re so many o th e r unknown f a c t o r s (one o f which was m entioned by th e xvitness to be c ig a r e t smoking) t h a t w itn e ss i s unable to d e f i n i t e l y r e l a t e Mr. Z i n i 's carcinom a to h is exposure to asbestos.
