Armstrong The Bendix Corporation Bendix Center Southfield, Ml 48076 Dear Jim: I was pleased to hear that you had accepted Chairmanship of our Asbestos Study Committee. Mr. Moalli, President of the Institute, had called last week and indicated that he would be going on vacation this week, and possibly the next. He had asked his Secretary to advise me when you accepted, and to contact you on this work. In our discussion yesterday, I indicated that there were two major areas of concern to the Membership: (1) The EPA's Office of Toxic Substances Control and any moves on their part on asbestos under the Toxic Substances Control Act, and (2) the industry draft of federal legislation for an "Asbestos Health Hazards Compensation Act. I sent copies of the discussion on these subjects at the June 1979 Board of Directors Meeting to the members of the Asbestos Study Committee. The President would like the committee to review these two subjects and make recommendations for Institute response or a.ction thereon to the Board. The Board would then review the committee recommendations and ind~te any guidelines or possible constraints on Institute response. The committee should recommend individual actions or responses coordinated with others, or in some fashion a plan for dealing with regulatory and legislative actions which could impact the friction materials manufacturers. You asked about a charter or other guidelines for the existing Asbestos Study Committee. There is no formal charter for the committee, and as I indicated it was formed in 1971 in response to the occupational regulations legislated by the Williams-Steiger Occupational Safety and Hea~th Act of 1970. The regulations first moved on asbestos in the workplace, and the Committee was formed to review regulations, and in certain cases respond thereto. The Committee has-made comments to the Illinois Pollution Control Board, to OSHA and to the EPA when regulations were proposed on asbestos. The Commitee is now called the "Asbestos Study Committee." The name could be changed. The commitee members could make their recommendations on that subject. Similarly, the committee members could propose areas of concern and guidelines for action. In other words, they could propose their own charter, which however would have to_be reviewed by the Board of Directors. FMSI 06998 -2- Further, the committee should consider both of these specific subjects (EPA and the Compensation Act) and make their recommendations for action to the Board. This should be done at a committee meeting, to be called as soon as you can schedule. Per our conversation, the balance of the committee--holdovers from the old committee-~ould be: Mr. Harry Wagner, Molded Materials Division of Carlisle Mr. Geoffrey Nicholson, Abex Corporation Friction Products Group Mr. David E. I had indiated that we should consider others for service to the committee and these were representatives from the following: Nuturn Corporation H. K. Porter Company Thiokol Chemical Corporation I would extend these invitations through the Delegate or Alternate of the Member, and if you had a particular individual in mind, would make that recommendation. I think before we have a meeting, we should make invitations to these Members for their participation. When we have the committee organized, we should then call for a meeting. When a meeting is called, I will go over a suggested agenda with you and then mail the suggested agenda with the meeting notice to the members of the committee.
