Arkansas SOLID WASTE Waste Reduction, Reuse, or Recycling Income T?<x Credit Arkansas SOLID WASTE Proposed rule of the Department of Environmental Quality, Pollution Control and Ecology Commission, amends Regulation 23 regarding income tax credits for waste reduction, reuse, or recycling. The rule defines "qualified manufacturer of steel," specifies what such manufacturers must do to qualify for the tax credits, and allows qualifying manufacturers to carry forward unused tax credits to subsequent years for 14 years. The rule also clarifies that specified actions by these manufacturers that do not constitute sales or transfers to a third-party purchaser are not disposals, transfers, or cessations. In addition, the rule revises the definition of "waste reduction, reuse, or recycling equipment." A hearing is scheduled for Aug. 14, 2017, in North Little Rock. Comments are due Aug. 14, 2017. The district is currently classified as moderate nonattainment for the 2008 ozone NAAQS, but the district's and the California Air Resources Board's monitoring data and modeling indicate that the district Sierra Club v. EPA, 1:17-cv-01906 ED_001523_00003060-00001 could not have met the 0.075 parts per million ozone standard by the applicable attainment date of Jan. 1, 2017. The plan addresses the district's request for a voluntary reclassification by the U.S. EPA to serious nonattainment and a revised attainment date of Dec. 31, 2020. The plan also specifies emissions control measures and provides modeling to demonstrate that the district can timely attain the 2008 ozone NAAQS by 2020. Comments are due July 26, 2017. The rule specifies permit fees of $37.34 per ton for coal-fired electric generating units and $35.50 per ton for all other facilities. The rule also references the manual for calculating air permit fees for calendar year 2016. The rule was submitted to the EPA as a revision to the Part 70 permit program. The rule is effective June 21,2017. The rule revises the definition of "unrefined and unprocessed ore" and addresses requirements for glazed ceramic tableware, weight content for glassware, and source material limits. The rule also addresses the use of radionuclides in the healing arts and notice of cancellation of a nuclear waste shipment with advanced notification. The rule is effective June 21, 2017.
