Maksimuk also noticed a van parked in front of the residence with signage that read, "Work for Less 719 578-8000 ColoradoWorkForLess.com Handyman, Plumbing, Electrical,Remodels, HVAC & More" Maksimuk observed the worker, Ron Fresquez, attempting to encase a painted wood window frame with sheet aluminum by hammering the metal to the contour of the painted wood frame. In doing so, paint chips fell on the concrete patio floor. Mr. Fresquez did this repeatedly on multiple areas around the window. Maksimuk identified himself to Mr. Fresquez and explained the purpose of the visit. During this time, Robert Washington exited the house and asked, "What's going on?" Maksimuk briefly observed the interior of the house. The interior, where visible, had what appeared to be newly painted walls and possible tarps on the floor. There was no furniture visible or household decorations or other items which would indicate the house was currently occupied. Maksimuk observed the exterior of the house was freshly painted and paint chips were on the ground in many areas. Mr. Washington stated "the paint chips are there because I painted the exterior of the house myself about 2-weeks ago". Maksimuk asked Mr. Fresquez if he was working for "Work for Less". Mr. Fresquez stated he was working for Mr. Washington on this one project and was acting as an independent contractor.
