Box 180 Fort Sumner, NM 88119 villageoffsmayor@gmail.com Re: Administrative Order; Docket Number: CWA-06-2023-1762 NPDES Permit Number: NM0023477 Dear Mayor Gallegos: On April 22, 2025, our office received a request from the Village of Fort Sumner, regarding the Administrative Order (AO) issued for the Village's Wastewater Treatment Plant, by the Environmental Protection Agency (EPA) on July 6, 2023. The request is for an extension of Task #8, due to supply chain delays along with a lack of needed expertise availability and, considerably slowing progress of the plant's rehabilitation and construction upgrades. The extension request has been approved and the due date has been extended to November 15, 2025. In addition, please remember that Tasks #10 and #11, requiring construction specific information and reporting must also be submitted to EPA within 5 days of the Village receiving it from the contractor(s). This is not applicable if construction has not begun, and therefore no reports can be generated. The EPA is committed to ensuring the implementation of, and compliance with, with Clean Water Act (CWA), 33 U.S.C. 1251-1387, and National Pollutant Discharge Elimination System (NPDES) permits issued under the CWA, which helps to meet its mission of protecting human health and the environment. This office helps meet the mission through compliance assistance and/or enforcement proceedings where necessary. Granting this extension to the AO is by the discretion of this office. Issuance of an extension shall not be deemed an election by EPA to waive any administrative, judicial, civil, or criminal action to seek penalties, fines, or other relief under the Act for the violations cited herein, or other violations that become known to EPA.
