Violations were identified during a permit file review and during an inspection of your wastewater treatment facility, conducted by the New Mexico Environment Department on April28, 2011. The inspection results were discussed with you during a post-inspection phone call. The violations alleged include, but are not limited to, the following: I) Exceedance of permit effluent limitations; 2) failure to submit quarterly progress reports; and 3) failure to maintain proper operation and maintenance of the wastewater treatment facility, as required by the permit. The AO does not assess a monetary penalty; however, it does require compliance with applicable federal regulations within thirty (30) days of its receipt. The AO also contains other compliance deadlines and information demands. Box 5469 Santa Fe, NM 87502-5469 UNITED STATES ENVIRONMENTAL PROTECTION AGENCY 1445 Ross Avenue, Suite 1200, Dallas, TX 75202 FINDINGS OF VIOLATION AND COMPLIANCE ORDER AND INFORMATION DEMAND Docket Number: CWA-06-2013-1762; NPDES Permit Number: NM0027731 Statutory Authority The following fmdings are made and Order issued under the authority vested in the Administrator of the United States Environmental Protection Agency ("EPA") by Sections 308 and 309(a) of the Clean Water Act ("the Act"), 33 U.S.C. 1318 and 1319(a). The Administrator of EPA delegated the authority to issue this Order to the Regional Administrator of EPA Region 6, who further delegated this authority to the Director of the Compliance Assurance and Enforcement Division. Findings I. The Village of Chama ("Respondent") is a "person," as that term is defined at Section 502(5) of the Act, 33 U.S.C. 1362(5), and 40 C.F.R. 122.2. 2. At all times relevant ("all relevant times") to this Order, Respondent owned or operated the Village of Chama wastewater treatment plant, located approximately 0.5 miles west of U.S. Highway 84/64 and the intersection of NM State Highway 17 in the Village of Chama, Rio Arriba County, New Mexico ("facility"), and was, therefore, an "owner or operator" within the meaning of 40 C.F.R. 122.2. 3. At all relevant times, the facility was a "point source" of a "discharge" of "pollutants" with its municipal wastewater to the receiving waters of the Rio Chamita, thence to the Rio Chama in Segment No. 20.6.4.119 of the Rio Grande Basin, which is considered a "water of the United States," within the meaning of Section 502 of the Act, 33 U.S.C. 1362, and 40 C.F.R. 122.2. 4. Because the Respondent owned or operated a facility that acted as a point source of discharges of pollutants to waters of the United States, Respondent and the facility were subject to the Act and the National Pollutant Discharge Elimination System ("NPDES") program. 5. Under Section 301 of the Act, 33 U.S.C. 1311, it is unlawful for any person to discharge any pollutant from a point source to waters of the United States, except with the authorization of, and in compliance with, an NPDES permit issued pursuant to Section 402 of the Act, 33 U.S.C. 1342. 6. Section 402(a) of the Act, 33 U.S.C. 1342(a), provides that the Administrator of EPA may issue permits under the NPDES program for the discharge of pollutants from point sources to waters of the United States. Any such discharge is subject to the specific terms and conditions prescribed in the applicable permit. 7. Respondent applied for and was issued NPDES Permit No. NM0027731 ("permit") under Section 402 of the Act, 33 U.S.C. 1342, which became effective on July I, 2007 and expired on September 30, 2010. The expired permit was administratively continued until the new permit, which became effective on November I, 2011, was re-issued. At all relevant times, Respondent was authorized to discharge pollutants from the facility to waters of the United States only in compliance with the specific terms and conditions of the permit. 8. Parts IILC and IILD of the permit require Respondent to sample and test its effluent and monitor its compliance with permit conditions according to specific procedures, in order to determine the facility's compliance or noncompliance with the permit and applicable regulations. They also require the Respondent to file with EPA certified Discharge Monitoring Reports ("DMRs") of the results of monitoring, and Noncompliance Reports when appropriate. 9. Part LA of the permit places certain limitations on the quality and quantity of effluent discharged by the Respondent. The relevant discharge limitations for the permit effective July I, 2007 are listed in Attachment A and the relevant discharge limitations for the permit effective November I, 2011, are listed in Attachment B. 10. Certified DMRs filed by the Respondent with EPA in compliance with the permit show discharges of pollutants from the facility that exceed the permitted effluent limitations established in Part LA for the 2007 permit as specified in Attachment C and for the 20 11 permit in Attachment D. 11. Pursuant to Part LB of the 2007 permit, Respondent was required to meet final effluent limitations for aluminum no later than three years from the permit's effective date. Part LB of the 2007 permit was violated in that the Respondent failed to meet final effluent limitations for aluminum by July I, 2010. Docket No. CWA-06-2013-1762 Page 2 12. Each instance in which the Respondent discharged pollutants to waters of the United States in amounts exceeding the effluent limitations contained in the permit was a violation of the permit and Section 301 of the Act, 33 U.S.C. 1311. Each violation of the conditions of the permit or regulations described above is a violation of Section 301 of the Act, 33 U.S.C. 1311. 13. The most recent inspection of the facility, conducted by the New Mexico Environment Department ("NMED") on May 28, 2011, rated the following areas as unsatisfactory: Recordkeeping and Reporting, Operations and Maintenance, and Flow Measurement. 14. Part I.C of the permit was violated in that Respondent did not submit quarterly progress reports to EPA and NMED showing failure to meet final effluent limitation requirements for Aluminum. IS. Part III.B.3 of the permit (Proper Operation and Maintenance) was violated in that the aeration pumps, located within the lagoons, were not providing proper aeration to the lagoons, which can cause septic and/or anoxic conditions to exist in the lagoons and potentially impede the treatment process. 16. Part III.B.3 of the permit (Proper Operation and Maintenance) was violated in that the recirculation pump, used to return influent to the eastern pond for further treatment, was out of order. 17. Part III.C.4.a of the permit (Record Contents) was violated in that the facility did not record the exact place and time of sampling and measurement. 18. Part III.C.4.e of the permit was violated in that the facility did not record the analytical techniques or methods used to analyze pH and Chlorine. 19. Part III.C.6 (Flow Measurements) of the permit was violated in that the facility had no calibration records on file and no calibration tests were performed to ensure a maximum deviation rate of I0% from true discharge rates. 20. Pursuant to Part I.B.2 of the 2011 permit, Respondent shall submit quarterly progress reports regarding the facility achieving compliance with Total Phosphorus and Nitrogen limitations. A recent file review determined that Respondent has not yet submitted progress reports for Total Phosphorous and Nitrogen, as required by Part I.B.2 of the permit. 21. Pursuant to Part I.C of the 20 II permit, Respondent shall submit to EPA and NMED a summary of the Nutrient Management Identification Plan that addresses existing commercial users and potential phosphorus loadings. A recent file review determined that Respondent has not yet submitted the summary, as required by Part I.C of the permit. SECTION 309(a)(3) COMPLIANCE ORDER Based on these fmdings and pursuant to the authority of Section 309(a)(3) of the Act, 33 U.S.C. 1319(a)(3), EPA orders that Respondent take the following action upon receipt of this Order: A. Within thirty (30) days of the effective date of this Order, return equipment to proper working order to ensure the treatment system is operated as efficiently as possible and in a manner which will eliminate non-compliance with peqnit effluent limitations and the discharge of pollutants. B. As required by Part I.B.2 of the permit, submit to EPA and NMED quarterly progress reports (January I, April I, July I, and October I) which record the progress made on meeting effluent limitations for total phosphorus and nitrogen permit conditions as well as a compliance plan which contains the following elements: a. A determination of exceedance cause(s); b. identification and development of control options (if needed); c. an evaluation and selection of control mechanisms; d. a list of corrective actions to be implemented; and e. achievement of final effluent limitations no later than five (5) years from the effective date of the permit. C. As required by Part I.C of the permit, submit to EPA and NMED a Summary ofthe Nutrient Management Identification Plan. SECTION 308 INFORMATION DEMAND Based on the foregoing Findings and pursuant to the authority of Section 308 of the Act, 33 U.S.C. 1318 Respondent is required to do the following: A. Within thirty (30) days of the effective date of this Order, Respondent shall certifY compliance with permit effluent limitations for E. coli (Daily Maximum and 30-D~y Averages); pH (minimum and maximum); TSS (7-Day Average, 30-Day Average and % Removal); BOD (7-Day Average, 30-Day Average and % Removal); and TRC (Maximum). Docket No. CWA-06-2013-1762 Page 3 B. Within thirty (30) days of the effective date of this Order, Respondent shall provide EPA with a list of all mechanical and operational deficiencies at the facility including those noted in this Order and a narrative describing the specific actions taken to correct violations for E. coli (Daily Maximum and 30-Day Averages); pH (minimum and maximum); Total Suspended Solids (7-Day Average, 30-Day Average and % Removal); Biochemical Oxygen Demand (7-Day Average, 30-Day Average and% Removal); and Total Residual Chlorine (Maximum). C. In the event it will take the Respondent longer than thirty (30) days to provide an explanation as to why effluent exceedances cannot be corrected, a schedule for repair/correction shall be submitted to the EPA for review and approval. The schedule shall be submitted to EPA within thirty (30) days of the effective date of this Order. D. Any approved compliance schedule will be incorporated herein and re-issued in a futore administrative order. E. If Respondent would like to arrange a meeting with EPA to discuss the allegations in this Section 309(a)(3) Compliance Order or the Section 308 Information Demand, it should contact EPA within forty-five (45) days of the effective date of this Order. The meeting will be held at the Region 6 offices, 1445 Ross Ave., Dallas, Texas, and Respondent can provide any information it believes is relevant to this Order. Respondent shall submit to EPA all information or materials it considers relevant at least ten (I 0) days prior to the meeting. F. Issuance of this Section 309(a)(3) Compliance Order and the Section 308 Information Demand shall not be deemed an election by EPA to forego any administrative or judicial, civil or criminal action to seek penalties, fines, or any other relief appropriate under the Act for the violations cited herein, or other violations that become known. EPA reserves the right to seek any remedy available under the law that it deems appropriate. Failure to comply with this Section 309(a)(3) Compliance Order, Section 308 Information Demand, or the Act can result in further administrative action, or a civil judicial action initiated by the United States Department of Justice. This Order does not constitute a waiver or modification of the terms or conditions of the Respondent's NPDES permit, which remain in full force and effect. Compliance with the terms and conditions of this Order does not relieve the Respondent of its obligation to comply with any applicable federal, state, or local law or regulation.
