PLAINTIFF'S EXHIBIT Julius Nemeth Louis Gillich August 30, 1977 cc: Tom Sullivan, Jim Harman Louis: Like you have read and reread the Federal Register publication on the proposed ban for respirable free-form asbestos, I believe your ques tion still remains unanswered until the final ban is put into effect. / t It sculd appear that if the materials were going directly to a con-, tractor and/or directly to a large commercial project that the material would be exempt and/or the ban would not apply, but what the Consumer Product Safety Commission is wrestling with at the present tine is the fact that the material may still get in the hands of the consumer and, of course, the easiest way to prevent this is to make it an all in clusive ban. In fact, at the public hearing, I suggested to them that labeling to the effect that the material was for industrial or commercial use only should, in fact, be sufficient to alert the consumer not to use the material and that they consider exempting on that basis.
