Dow and Firestone agree to amend the provisions of said contract as follows: ** A. Price Change 1. Delete paragraph 15, page 4 and paragraph 16, page 5. 2. Substitute as paragraph 15 - "Seller may increase the price on the first day of any month upon 15 days prior written notice. Buyer's failure to make written objections to the increase prior to the effective date shall be considered acceptance. The price charged hereunder may not exceed Seller's PVC Industry Price. (Seller's PVC Industry Price is that price arrived at by operation of this paragraph 15, applied generally to Seller's VCM customers who are PVC producers.) B. Competitive Offer 1. Add the following paragraph as paragraph 16 - "If Buyer receives a written offer from a domestic producer not controlled by or controlling Buyer, to supply, in place' /' of Seller, all the goods remaining to be supplied , hereunder which are of like quality, for a like use and < deliverable in like quantities, at a delivered cost less ' than the then effective delivered cost hereunder, upon Buyer's written notice stating all the terms and condi tions including the quantity the Buyer intends to purchase of the competitive offer. Seller shall by written notice within thirty (30) days of receipt of Buyer's notice (a) meet the competitive offer and amend this contract accordingly, (b) choose not to meet and deduct from seller's maximum obligation to supply the quantity that the Buyer intends to purchase from the competitive source, or (c) cancel the contract." ?
