This is to confirm my telephone conversation with you today. Attached are additional copies of the letter of transmittal and the application for adjudication of claim filed by Kaiser Foundation Hospital/Permanente Medical Group.
Yesterday, John McCarthy, Branch Manager, Liberty Mutual Oakland, was in the plant, and we asked that he take immediate action to gain all the facts in this case. It was agreed that he would immediately take steps to:
1. subpoena Kaiser Hospital records on the Brownlee case.
2. recover any and all records maintained by Dr. Maxwell.
3. contact Liberty Mutual attorneys and ask them to assign a new doctor to review the Kaiser records along with any records recovered from Dr. Maxwell's office.
Assuming that the new medical findings confirm our previous under-

condition rather than inhalation of toxic fumes, we would ask that
the attorneys meet with the Kaiser legal representative in an effort
to have this claim cancelled.
Today, Mr. McCarthy called me back to advise that they have taken steps to obtain Kaiser Hospital records. They have contacted the doctor's office and should have information on availability of these records on Friday, August 24. Their attorneys are not prepared to assign a new doctor pending investigation of who has taken over Dr. Maxwell's practice.
I will plan to follow Liberty Mutual on Friday afternoon, August 24, for a progress report.
