I thought it was generally agreed by all of the parties involved that this claimant could not return to work. Therefore, I defined my role as one of trying to coordinate and/or negotiate a settlement of the case or, in the alternative, to increase our reserves to more accurately reflect our exposure. It was not our intent, nor did we intend to suggest, that the value of this case for settlement purposes was $80,000. But, we assume that since you have proposed no counter to the $80,000 demand that you do not wish to attempt to negotiate a settlement at this time. You probably recall that the question of compensability has been adjudicated. The claimant's stroke was found to have arisen out of the employment. It re mains the principal medical issue. Dr. McNabb's report of July 29, 1988 ( a copy attached) indicates little more than that he continues to treat for the stroke. We can request that Gerald Childrey, the Claims Representative on this case, attempt to arrange a Rehab evaluation to determine whether job placement and/ or vocational training is feasible for this 61-year old claimant.
