Ladies and Gentlemen:
On March 6, 2001, we notified USEPA, WVDHHR, and WVDEP that our law firm had received over 100,000 pages of documents from E.I. duPont de Nemours and Company ("DuPont") in connection with ammonium perfluorooctanoate (a/k/a "C-8") and offered to make those documents available to the agencies (subject to the requirements of our protective order with DuPont). We did not receive a response from the agencies. Over a year later, on March 26. 2002, after receiving approximately 60,000 to 70,000 more pages of C-8 documents from DuPont, we again notified USEPA and WVDEP (along with Ohio EPA) that we possessed a substantial amount of data relating to the toxicity and effects of C-8, and again offered to make that documentation available to the agencies. In our letter, we notified the agencies that many of the documents, although potentially relevant to the CAT Team efforts under the referenced Consent Decree, may not otherwise be available to the non-DuPont CAT Team members. We

also requested any opportunity to designate a representative who already had reviewed all of this information to serve as additional member of the CAT Team, given the apparently short amount of time left for the CAT Team to complete its work on C-8. As of today's date, we have not received a formal response from any of the agencies. We have, therefore, enclosed a copy of our submission to USEPA's IRIS Submission Desk concerning C-8 to alert the non-DuPont CAT Team members of the type of information that is available on C-8.
