This law required the California Department of Health Services (DHS) to establish a program to interim certify people who work in lead-related construction and accredit training providers who teach lead-related construction courses. New regulations establishing the program were filed with the Secretary of State on June 29, 1994 and are now in effect (Title 17, California Code of Regulations, Division 1, Chapter 8, Section 35001 et. seq. entitled "Accreditation of Training Providers and Interim Certification of Individuals Engaged in Lead-Related Construction Work). What kind of lead-related construction do these regulations apply to? Currently, California's Accreditation & Certification regulations apply to any construction, alteration, painting, demolition, salvage, renovation, repair or maintenance of any residential, public or commercial building, including preparation and cleanup, that, by using or disturbing lead-containing material or soil, may result in significant exposure of individuals to lead. In the near future, the Department will develop new regulations which govern lead-related construction work done on industrial buildings and steel structures. What is accreditation? Accreditation is granted to any individual, corporation, partnership or other unincorporated association or public entity which offers at least 1 DHS-approved course and satisfies the applicable requirements specified California's new lead-related construction training regulations Accredited training providers may offer lead-related construction courses in: Inspection/Assessment Supervision and Project Monitoring Project Design Work Continuing Education Continuing Education for Workers Accreditation is non-transferable and must be renewed every 3 years. Is accreditation mandatory? As of November 1, 1994, all lead-related construction training leading toward DHSinterim certification must be taken from a DHSAccredited training provider. Students taking courses after November 1, 1994, from nonDHS-Accredited providers are not eligible for interim certification. What is interim certification? Interim certification is granted to any individual who satisfies California's eligibility requirements to perform lead-related construction in residential, public, and commercial buildings. The Department grants interim certification for the following 5 lead-related construction disciplines: Inspector/Assessor Supervisor Project Monitor o Project Designer Worker Interim certificates are granted to individuals only. The new version of these regulations, filed on April 5,1995, are now in effect and include revised eligibility requirements for interim certified lead-related construction personnel. The new eligibility requirements are outlined in the table below. You should use this table to determine whether or not you are eligible for interim certification.
