Industries Association was held on Monday, November 6, 1933 in the Board Room of the national Lead Company, 111 Broadway, New York City, at 11:45 A.M. Present Representing Clinton H. The Chairman stated that the Pigments Division had concluded the drafting of a Supplementary Code of Fair Competi tion and vas ready to have it approved by the Executive Committee, for submission to the Administrator in Washington. Whereupon it vas moved and seconded that the third draft of the Supplementary Code of Fair Competition for the Lead Pigments Division, as appended to these minutes, be ap proved for submission to the National Recovery Administration, whenever the Pigments Division desires to submit it. Unanimously carried. The Chairman presented the application of the Rex Metal Works for membership in the Lead Industries Association. LIA 0?4 4 5 nrr thereupon it was moved, eeoonded and carried that the Rex Uetal Works be admitted to membership in the Lead Industries Association. i The Chairman reported the death, on JTovember 2, of Capt. E. J. Raddatz, President of the Tintic Standard Mining Company, one of the charter members of the Lead In dustries Association Whereupon the following resolution was adopted: WHEREAS the untimely death of Captain E. J. Raddatz has deprived the lead mining industry of an outstanding leader in the development of Utah's mining resources, and whose kindly cooperation and counsel have always been of inestimable value to his friends and colleagues BE IT HEREBY RESOLVED that the Lead Industries Association, representing the entire lead mining in dustry in the United States, through its Executive Committee, mourns the loss of one of itB members and. extends to his family and associates, its deepest sympathy. Hr. Carter reported the result of a conversation he had had in Chicago, with a former representative of the Retail Lumber Associations in the United States, who proposed the cultivation of a closer contact between the Retail Lumber Dealers in the United States and the manufacturers of white lead, for the advancement of their mutual interests, lumber and paint being frequently sold by the same dealers. In ferior paint8 had adversely affeoted the market for lumber. Mr. Carter felt that the general problem of cooperative work with the lumber dealers, looking toward an increased U6e of white lead, was essentially an Association matter, a view in L 1 f>0244fc tv which the rest of the Executive Committee concurred. The Chairman thereupon requested Ur. Carter, Ur. Roosevelt and ' the Secretary to consult with the lumber representative upon his arrival in Sew York, so that a program oould be discussed for suitable later action. October 5, 1933 Lead Pigments Code Third Draft SUPPLEMENTARY CODE OF FAIR COMPETITION FOR TEE LEAD PIGMENTS DIVISION OF THE LEAD INDUSTRIES ASSOCIATION As provided in Art. XIII of the Code of Fair Compe tition for the Lead Industry, hereinafter termed the "Master Code" , this supplementary code Is hereby made a part of said Master Code with the same force and effect as any provisions thereof, except that it shall be applicable only to Lead Pig ments. as defined in Art. II of said Master Code; i.e., basic carbonate white lead, dry or in oil, basic lead sulphate, dry or In oil, litharge, red lead, dry or in oil, orange mineral and other lead oxides with ox without, metallic lead content. PRICE LISTS Art. 1. Each member of the Code shall file with the Secretary within ten (10) days after the effective date of this Code, his price list, together with terms and conditions of sale. Any change in the said liBt or terms shall be reported to the Sec retary in writin within twenty-four (24) hours after the effec tive date of such change. After December 31, 1933, any member making a sale or quotation at variance with his price list or terms on file at the time said sale or quotation is made, shall notify the Secretary concerning the variation by letter, mailed within twenty-four (24) hours. The Information, as reported, shall be re-issued to the members at such time, and in such manner as may be determined by them. UNIFORM SALES CONTRACTS Art. II. Uniform sales contracts specifically designed for use in selling Dry Vhite Lead and Lead Oxides shall be developed as soon as practicable and thereafter used by all members after said contract forms shall have been adopted by a two-thirds vote of members manufacturing the products to which the oontraots apply. From time to time, changes in the uniform sales con tracts can be made by a two-thirds vote of members manufactur ing such products. All sales shall conform to the conditions set forth in the uniform contract forms. UNFAIR TRADE PRACTICE8 Art. III. The following shall be considered unfair trade prac tices and are violations of this code. (a) Misbranding or misrepresentation of lead pigments. L I A 02 44 c N 639.01 (b) Making or promising to any purchaser or prospeotire porobaser of lead pigments, or to any offloer. employee, agent or representative of any such purchaser or prospective purchaser, any commission, gratuity, or other payment or re muneration, directly or indirectly, except In the case of payments made with the consent of the employer for a definite service rendered. (c) Inducing or In any manner attempting to induce a breach, default or cancellation of a contract between a com petitor and his customer during the term of such contract. (d) Guaranteeing for a definite time the life and/or ser vice of lead pigments. (e) Making false or derogatory statements with respect to the prices, policies, products, practices, business or credit to any competitor. (f) Exchanging the products of a member for those of another. (g) Ho merchandise shall be sold at a concession in price, or used as an inducement, to influence the sales of any lead pro duct, nor shall any concession be given in the price or terms of sale of a lead product to influence the sale of any other merchandise. r- " RETtFRHED GOODS Art. 17. Ho member of the Code shall accept the return of merchan dise without first giving consent for Its return. On such goods as are accepted for return, a reasonable obarge shall be made and freight charges must be prepaid by the shipper returning the mer chandise, except In the case of defective products or where In some other way the manufacturer may be responsible. TAXIS Art. 7. Any sales tar uniformly applicable upon all sellers shall be for buyer's account and shall be added to the selling prloe to be paid by the buyer. L 1/02^40
