When she read it, she called Mark Fitzsimmons. They both strongly felt that the words in the Shell letter would not accomplish what we wanted. They felt that it exposed the relationship between the consortium and API; gave API stronger authority; would not be supported by the other consortium members; and used too many words that provided targets. We had a lengthy discussion where they shared their reactions and we challenged each other. In the end, Jennifer elected to send a much shorter letter. They also felt that the consortium would be better served if our letters were aligned. With this as background, I called you and John. Not getting an answer, I called Elizabeth. We discussed both the Shell letter and Jennifer's letter. In the end, we recommend that I send a much shorter version of the letter. We recognize and appreciate all the work that went into crafting the language. However, on further reflection and having heard the reaction of both CP and Mark - which I view as a good barometer of what would be the consortium reaction - I feel that it is better to keep it short. I am requesting your support to send the attached letter. I recognize that we have missed the API deadline, but both Elizabeth and I feel that it was more important to get your input prior to sending. It has been brought to my attention that the letter did not expressly address the continuing role of American Petroleum Institute (API) as the administrator and contracting entity for the Study. The BHRC has no authority to make any commitment on behalf of API. We remain anxious to continue work on the Study and look forward to making progress in this area.
