In your absence I talked to Dave Gidley and it was agreed he would put down a comparison between the survey of June 17-19, 1974 and the September 10-14, 1973 survey. The objective being to highlight areas that increased the asbestos exposure in '-74 vs. '73 and try to explain why. I have reviewed C. B. Mallory's letter of 2-26-74 outlining the status of the recommendations included in the September 10-14, 1973 report. It seems there has not been a great deal of further cor rective progress since Charlie Mallory's 2-26-74 letter. We (Gidley) should follow up on the status of these items --- many. seem to be pending or "available*4 if desired are respirators being used more? With toy background in manufacturing X can be somewhat sympathetic; to CBM's concern re stirring up unrest by insisting on the use of respirators, ear plugs, and the posting of warning signs re hazardous substances. In my present position, however, I cannot condone ignoring the laws of the land. The problem is not easy but neither is it going to be re solved by letters back and forth. Rennie Vice President New York Office Dear Don: Last Friday we sent you a copy of the Industrial Hygiene Survey report which was performed on June 17-19, 1974 at Winchester. This was in essense a follow-up report covering departments or operations which previous survey information indicated a problem and which needed to be monitored again. I think that the most recent report speaks for itself. i I would like for you to also extract from your files a copy of Charles Mallory's letter to Dave Gidley concerning the September 10-14, 1973 survey report which was dated 2-26-74. I Realize that this is a large plant, that they have many problems, and that considerable capital expenditure would be required to accomplish all that is necessary. Any time that a workman is exposed to excessive levels of a substance or substances which might be injurious to his health, he should be informed of this exposure or these exposures or if it is an entire area of a plant, a proper sign or notice should be posted as specified under OSHA. In Item No. 8 of Charles Mallory's letter of 2-26-74, he indicates that' they have "an awful lot of unrest within the ranks now and I'm afraid that if we start forcing the wearing of respirators, posting signs, ear protection, etc., we would be letting ourselves in for more grief than the hazards present." Apparently he is willing to go this route even though he is technically incorrect. Do you think that it is proper to ignore accepted practices which should be utilized to assist in controlling exposures? I think that many of the negative comments which Charles Malloxy was compelled to state in his letter of 2-26-74 continue to exist and probably will until OSHA is aware of the same and levies appropriate fines. Should we let matters progress to this point, or could we prevail upon the Friction Products Group in Winchester to do something more positive?...
