FROM PITTSBURGH PROCUREMENT CONSTRUCTION - 20 TO R. J. BELANGER MASSENA OPERATIONS 1989 FEBRUARY 14 RE: ASBESTOS REMOVAL - LOOPRO FURNACE - ACPC. INC. This letter is to recap our telephone conversation of 1989 February 13. Present in the conversation, besides ourselves, were R. K. Morrow, S. R. Barr, S. M. Anderson, D. R. Wilson, and, W. B. Parker. The major points covered were as follows: 1. Project is estimated in the $20,000 - $50,000 range. 2. Massena Management has decided to proceed with their decision to require ACPC, Inc. to be responsible for the removal of the asbestos containing materials (ACM) from the furnace and the subsequent relocation of said furnace, with the furnace and the building(s) involved all belonging to ALCOA. The reasons were a) the original agreement with ACPC, Inc. states that they are responsible for the relocation of the furnace, and b) the successful bidder will be required to adhere to New York Code Rule No. 56 for asbestos work. This decision was arrived at after Massena having consulted with Tom Costa of the Pittsburgh Legal Department. 3. Massena Operations will determine the appropriate landfill to be used for the ACM disposal. 4. Massena Operations personnel will periodically monitor the contractor for compliance with the appropriate regulations (NY Code Rule No. 56, Clean Air Act, etc.) to minimize ALCOA'S vulnerability to any possible future litigation due to ALCOA being the "Facilities Owner". 5. It is IMPERATIVE that the contractor have "Occurrence-type" Liability Insurance, specifically for Asbestos related work. This is the only type of coverage under which a contractor may work on an ALCOA asbestos contract, and $1,000,000 is the minimum acceptable policy amount.
