Subject Bill of Lading Preparation on Truck Shipments of Asbestos This will confirm our phone conversation concerning bill of lading prepa ration for truck shipments of asbestos in bags, that are not "dust and sift proof". After discussing with the Law Department, we have concluded that Union Carbide has an obligation to inform carriers that our packaging requires the . exclusive use of the vehicle, under the current Department of Transportation 1 regulations. Until further notice, you should use the. wording shown'on the attached sample bill of lading to accomplish this. . . We were advised that the DOT shipping name and hazard, class (asbestos QRM-C) were not required on the shipping papers, nor was the shipper's certification that the shipment was properly packaged, marked and described in accordance with DOT regulations. You advised us that orders which were not being shipped directly to our customers (ie. shipments to warehouse and distributors) were doubled bagged and shrink wrapped in dust and sift proof packages. It is our understanding that these shipments do not require exclusive use, so no notation should be made on the bills of lading for such shipments. Rail carload and piggyback trailer load shipments which are loaded by the shipper and unloaded by the consignee, are essentially "exclusive use" ship ments, in that they are sealed and normally not transferred enroute. We do think that the suggested wording should be used on piggy back shipments, to pre clude the possibiity of someone transferring from the railroad trailers to highways trailers, between King-City and destination. Customer pickups (will calls) in customer's own equipment can be considered "exclusive use" according Stan Hoffman's memo of 6/21/79. However, this can be minimized somewhat, by the use of collect shipments via ITQFCA and by using B. J. McAdams, for shipments to points East of the Mississippi. If you can furnish information regarding the destinations and annual volume of truck/load shipments, we believe we could support several contract or irregular route common carriers for authority to provide "exclusive use" service at reduced cost. We may even be able to obtain emergency temporary authority for your next order, provided we are given sufficient lead time. We hope this information proves helpful.
