Subject: November 2, 2022, EPA Inspection Dear Mr. Lalrochelle: On November 2, 2022, the U.S. Environmental Protection Agency (EPA) performed a Clean Water Act inspection of the industrial activities located at 518 Silver St, Manchester, NH 03103. EPA and New Hampshire Department of Environmental Service representatives corresponded with representatives of Mid - City Body and Frame Inc., who claimed to be the landlord of your business, John's Shafts and Stuff, operated out of the same address. Observations were made regarding compliance with the National Pollutant Discharge Elimination System program of the Clean Water Act. A copy of the inspection report is included as an attachment to this letter along with a photo album. John's Shafts and Stuff was observed to have containers, including drums and / or plastic totes, with an above - ground oil storage capacity above the applicability threshold (1,320 gallons) of the Oil Pollution Prevention Regulations (40 C.F.R. Part 112). Oil storage containers at your facility did not have secondary containment. Based on observations made on the day of the inspection, your facility is required to have prepared and implemented a Spill Control and Countermeasures (SPCC) plan consistent with the Oil Pollution Prevention Regulations, or you must bring the facility's above - ground oil storage capacity below the regulatory threshold. Please report the following to the EPA in an electronic format to Alex Rosenberg within 30 days of receiving this letter, at Rosenberg.alex@epa.gov. 1. Provide either (a) a copy of the facility's current SPCC plan, or (b) evidence that the Facility's total above - ground oil - storage capacity is below 1,320 gallons. 2.
