Arizona WATER Water Pollution Control/Recycled Water Arizona WATER Proposed rule of the Department of Environmental Quality amends and renumbers regulations under R18-9-701 through -719 as R18-9-A701 through -D702; adopts regulations under R18-9A707 and -E701; and repeals regulations under RI8-9-601, -602, -603, and -720 to update and restructure requirements for reclaimed water and allow for the treatment of reclaimed water for potable use. The rule reorganizes provisions to clarify that gray water, industrial wastewater, and reclaimed water are all categories of recycled water. The rule also provides an exception to the prohibition against providing reclaimed water for human consumption to allow reclaimed water to be treated appropriately for potable use, adds interim permitting criteria for advanced reclaimed water treatment facilities, and modifies gray water permitting requirements. In addition, the rule revises notification and signage, reporting, and permit revocation requirements and establishes a recycled permit transition provision. The hearing is scheduled for July 6, 2017, in Sacramento. Comments are due July 20, 2017. The rule removes the authority of the board to make vested rights determinations under any circumstances when acting as the lead agency. The rule also clarifies the authority of the board when it assumes full authority as the lead agency when a lead agency fails to adopt a boardcertified mining ordinance. In addition, the rule allows lead agencies that have certified mining ordinances to retain their Surface Mining and Reclamation Act authorities if and when the board reviews a proposed amendment to a previously certified ordinance. The rule removes water conservation standards developed by the board because the measures are no longer necessary under current conditions. The rule supersedes portions of a Feb. 28, 2017, emergency rule that readopted regulations concerning water conservation. The rule is issued in compliance with an April 7, 2017, executive order (B-40-17) that directed the Sierra Club v. EPA, 1:17-cv-01906 ED_001523_00003423-00002 rescission of emergency rule requirements for water supply stress tests or mandatory conservation standards for urban water agencies; the continuation of the prohibition of certain wasteful water practices; and the continuation of water use reporting requirements. The revisions also address the good neighbor provisions concerning significant contribution to nonattainment and interference with maintenance requirements. The draft plan, which will be submitted to the U.S. EPA for approval, does not include any new or revised requirements. Comments and hearing requests are due July 24, 2017.
