OPENING CONFERENCE We met Mr. Boger outside of the Environmental Health & Safety Center located at 1000 Regent Drive, EH&S Building H-13, and he brought us to a conference room for the opening conference. Ms. Maxwell and I presented our credentials to Mr. Boger, Mr. Wright, Mr. Lapham and Mr. Kupecz. We were not denied access to the facility and were allowed to inspect all areas that we selected for inspection. Mr. Lapham, Mr. Kupecz, and Ms. Gates-Mayer accompanied us at the permitted hazardous waste storage area and Mr. Wright and Ms. Gates-Mayer accompanied us throughout the generator areas. Company Ownership: CU Boulder is a state-run university owned by the state of Colorado. General Facility and Process Description: During the opening conference of the inspection, Mr. Kupecz, Mr. Lapham and Mr. Wright, explained the university's hazardous waste generation and storage. Regulatory Status According to RCRAInfo, the main campus of CU Boulder is a large quantity generator (LQG) of hazardous waste and is a permitted hazardous waste storage facility under CDPHE State RCRA Permit No. CO-20-11-23-01. During the inspection, Mr. Lapham confirmed that CU Boulder was an LQG and TSD. Based on my observations of waste generation and the amount of waste on-site, the facility appeared to be generating at least 2200 pounds of hazardous waste per month and was therefore a large quantity generator at the time of the inspection. Site Hazardous Waste Information This inspection only addressed the CU Boulder main campus. There are a number of CU Boulder and CU Denver extension campuses that operate under separate EPA RCRA ID numbers. In addition to hazardous waste generated on the main campus, CU Boulder's permit allows the main campus to receive, consolidate, and store hazardous waste from all of the other CU campuses except the Anschutz Medical Campus. Hazardous waste generated on other campuses is accumulated in 90- and 180-day areas before it is transported to the CU Boulder main campus permitted storage area under a hazardous Facility Name: University of Colorado - Boulder (COD007431505) Facility Location: 1000 Regent Drive, Boulder CO Date of Inspection: July 19, 2022 Page 3 of 8 waste manifest. CU Boulder signs as the destination facility when the waste is received and then remanifests the hazardous waste when it is shipped to the final TSD. Hazardous waste collected on the main campus is transported under a contiguous property manifest. Hazardous waste is stored in the permitted storage area in the lower level of the Environmental Health & Safety Center building. The hazardous waste storage area is trenched (with no drains) for spill containment and wastes are separated based on compatibility. There is a separate room with a door where oxidizers are stored. CU Boulder also stores mixed radioactive waste in a separate area of the same building. There is a universal waste accumulation area in the permitted storage area. There is also a walk-in hood where small containers of compatible hazardous waste generated in labs are consolidated into drums, including acids, bases, and corrosives. CU Boulder has 188 teaching and research labs on its main campus that generate the majority of the hazardous waste managed at the site. A small amount of hazardous waste is also generated in the ceramics and photography studios in the art department, among other locations. Some vehicle maintenance is performed onsite; however, most is done on the East Campus. Mower maintenance is done in the grounds building, where used oil is generated in containers labeled as used oil. There is one 90-day area and approximately 310 satellite accumulation areas (SAAs) on the main campus. CU Boulder tracks hazardous waste generated at various locations across all campuses using a carbon-copy paper tagging system. They also use BioRAFT lab management software that tracks lab management, training, equipment and weekly SAA inspections performed by lab personnel, in addition to other elements. Mr. Wright stated that he conducts an annual inspection at every SAA on campus. According to Mr. Wright, lab staff are instructed to send in copies of the paper tags for pick-up when any 55-gallon SAA waste containers are approximately three quarters full. EH&S staff then pick up the containers within 2-4 business days and transport them to the permitted hazardous waste storage area. According to Mr. Lapham, the EH&S staff make hazardous waste determinations based on the information provided by the labs once the waste is received at the hazardous waste storage area. The hazardous waste is picked up by Veolia three times per year; generally in March, July, and October. The next pick up following the inspection was scheduled for July 21, 2022. Mr. Kupecz said that they will ship approximately 100 containers. They also do smaller shipments throughout the year, consisting of non-hazardous waste, used oil, antifreeze, paints, and universal waste bulbs and batteries. Waste Management picks up their non-hazardous waste. Mr. Wright explained that lab staff, generally the principal investigator or assistant, are responsible for performing weekly SAA inspections. They receive a 60-90 minute annual general lab safety training, including identifying hazardous waste, which is tracked through the BioRAFT system. He also noted that if a teaching lab SAA contains hazardous waste, but is not being used during the summer months, permanent EHS& staff will perform the weekly inspections. Mr. Kupecz explained that CU Boulder also has two solvent recovery distillation units - one in the Environmental Health and Safety Center for ethanol, acetone, and methanol, and one in the Ekeley Sciences building for acetone. He said that currently, the museum collection is the biggest user of the ethanol still as they are changing out the ethanol in their preservation jars. He also explained that they recently started a quality assurance (QA) program to reduce contamination in the recycled solvent. Facility Name: University of Colorado - Boulder (COD007431505) Facility Location: 1000 Regent Drive, Boulder CO Date of Inspection: July 19, 2022 Page 4 of 8 Previous to this inspection, the permitted storage area and generator areas were inspected by EPA and CDPHE on July 9, 2021, resulting in a Notice of Violation for failure to properly manage satellite accumulation containers and failure to maintain training records. These violations were corrected and several new waste management processes were implemented. Since the last inspection, several changes have taken place. Mr. Lapham explained that for corrosive aqueous wastes not containing RCRA metals, CU Boulder had been treating the wastes using a batch neutralization process; however, they have not recently treated hazardous waste and will probably be removing the acid/base and ultraviolet/oxidation (UV/OX) treatment tanks. Mr. Kupecz said that since March 2022, they have been shipping off more hazardous waste rather than treating it. At that point, they cleaned the tank, which was not holding any material at the time of the inspection. Mr. Kupecz also stated that they had disposed of chemicals purchased for the neutralization process. Mr. Lapham also explained that they have an ion exchange tank for silver recovery from photo fluids, however they have also reduced the use of this process and are deciding if they will continue to use it in the future. DESCRIPTION OF INSPECTION Areas of the facility toured: Mr. Kupecz and Mr. Wright led us on a tour of the facility. We looked at the university's processes, including hazardous waste management practices, generation points, and accumulation areas. We also looked for wastes that facility representatives had not yet identified or designated as hazardous. Specifically, we inspected the following areas of the facility: x Environmental Health and Safety Center (EHSC) o Permitted hazardous waste storage area Oxidizer room: oldest accumulation start date was 8/9/21 UW storage area o Room 150: Chemical Treatment Room Ethanol solvent distillation unit o Room 135: Permitted mixed waste storage area Three 1-gallon containers with accumulation start dates of 7/14/21, 10/5/21, 1/19/22 x Museum Collections (MCOL) o Room W130 x Mackey Auditorium o Room 1B04: small photo darkrooms x Ekeley Sciences (teaching and research labs) o Room M1B10: 90-day storage and acetone distillation unit o Room M1B65: teaching lab o Room M272: general chemistry teaching lab SAA had been cleaned out for the summer; no hazardous waste present x Cristol Chemistry o Rooms 65 & 67: Luca research lab x Ramaley Biology o C127: Smith lab Facility Name: University of Colorado - Boulder (COD007431505) Facility Location: 1000 Regent Drive, Boulder CO Date of Inspection: July 19, 2022 Page 5 of 8 Only those areas in which we observed potential compliance concerns or noted pertinent activities are further discussed below. Observations: Permitted hazardous waste storage area The oldest date that I observed on a container in the Hazardous Waste Storage Area was 7/30/21, which was less than one year before the date of the inspection. Mr. Kupecz explained that they have a system to check the dates in their inventory and mark any containers that are nearing one year. He also explained that EH&S bulks compatible solvent waste in the hazardous waste storage area every 1-2 weeks. He said that they have updated their process since the last inspection, and when waste is bulked into a new container, the new container is marked with the oldest accumulation start date from the wastes that are bulked. EHSC Room 150 - Chemical Treatment Room: I observed a small solvent distillation unit mainly used to recover ethanol. According to Mr. Kupecz, containers of ethanol waiting to be processed in the still are labeled with accumulation start dates and stored in the permitted storage room. He also explained that any waste liquid is stored in a 5-gallon carboy. I observed the ion exchange tank which, according to Mr. Kupecz, is used for silver recovery from photo fluids. He explained that the process is to receive 30 gallon batches of photo fluid and adjust the pH before each batch is added to the ion exchange tank for treatment. The photo fluid is treated to the Boulder city standard of less than 50 ppm silver (total) so it can be discharged to the POTW. At the time of the inspection, the tank held approximately 200 gallons that had been pH adjusted and treated in the ion exchange tank; however, during treatment, the silver concentration increased to greater than 53 ppm instead of decreasing. Mr. Kupecz said that they were considering drumming the waste for disposal instead of continuing to try to meet the POTW standard if they could not get the silver concentration to go down. Also in the Chemical Treatment Room, I observed a small bin holding a plastic bag labeled with a hazardous waste tag with the contents identified as dry debris with trace morphine and fentanyl. The bin also held three 1L bottles with a hazardous waste tag with the contents identified as aqueous solution containing trace morphine and fentanyl (photo 1). Mr. Kupecz said that he did some hazardous categorization and that the solutions contained minor concentrations of pharmaceuticals and that the wastes were determined to be non-hazardous. He said that they were holding the wastes while they determined if the wastes should be sent to the Anschutz medical center for disposal. Museum Collections (MCOL) Room W130: Mr. Wright introduced the inspectors to Emily Braker, who is working on replacing ethanol in the museum collection's preservation jars. There was a satellite accumulation area with two 5-gallon carboys collecting ethanol for distillation. One container that was about 75% full was closed and labeled as hazardous waste but was missing an indication of the hazard. Ms. Braker labeled the SAA container as ignitable waste during the inspection. Facility Name: University of Colorado - Boulder (COD007431505) Facility Location: 1000 Regent Drive, Boulder CO Date of Inspection: July 19, 2022 Page 6 of 8 Ekeley Sciences Room M1B10: I observed a small solvent distillation unit used to recover acetone. The unit produces hazardous waste sludge that is cleaned out when serviced. Mr. Wright explained that this room is a 90-day area, since labs throughout the building generate acetone in satellite containers that are brought here and held before they are processed in the still. At the time of the inspection, I observed one full 5-gallon container and one 80% full 5-gallon container of hazardous waste acetone that Mr. Wright said were going to be picked up by EH&S and transported to the permitted storage area. These satellite containers were closed and labeled as "Hazardous Waste" with an indication of the hazard. I observed two full 5-gallon containers of hazardous waste acetone that Mr. Wright said were waiting to be processed in the still (photo 2). These containers were closed and labeled as "Hazardous Waste" with an indication of the hazard. However, because they had been transported from satellite areas in teaching labs, these containers should have been considered 90-day containers, but they were not labeled with accumulation start dates. I also observed one 20% full 5-gallon container of hazardous waste acetone that Dr. Richardson said was the container that she was currently processing through the still. This container was closed and labeled as "Hazardous Waste" with an indication of the hazard. I observed empty containers in a flammable cabinet that had been prepared to collect acetone waste. The containers had been labeled with the words "Hazardous Waste," "flammable," and a space for an accumulation start date. I noted that 90-day and SAA weekly inspections were performed and recorded on a log on the flammable cabinet. Room M1B65 Teaching Lab: Mr. Wright stated that this was a teaching lab. I noted that some process changes had been made since the previous inspection, specifically that no SAA containers were available in the teaching hoods. Mr. Wright explained that students now dispose of small amounts of waste directly into the three 55-gallon SAA containers labeled as "hazardous waste - organic waste," "hazardous waste - aqueous waste," and "hazardous waste - acetone recycling" at the end of their class. Cristol Chemistry Rooms 65 and 67 - Luca Research Lab: I observed SAAs with three 5-gallon containers and three 1-gallon containers. When we arrived in the lab, one of the 1-gallon containers was open with a funnel in the top (photo 3). However, one of the laboratory staff clarified that the container was in use and closed it during the inspection. Records Review: The following documents were reviewed at the facility: x Permitted hazardous waste storage area daily, weekly, and monthly inspection logs (July 2021 - June 2022) x Hazardous waste manifests with land disposal notifications: July 2021 - present Facility Name: University of Colorado - Boulder (COD007431505) Facility Location: 1000 Regent Drive, Boulder CO Date of Inspection: July 19, 2022 Page 7 of 8 x Hazardous waste training records for EH&S staff (Chris Quattrociocchi, Joe Gibbs, John McCammon, Stephen Kupecz, and William Moore) x Contingency plan: a contingency plan for the LQG areas and quick reference guides for specific buildings had been added since the previous inspection At the time of the inspection, copies of the signed return manifests for shipments in November 2021 and March 2022 were not available (manifest numbers: 002037610VES (11/18/21), 002037611VES (11/18/21), 001876476VES (3/31/22), 001876477VES (3/31/22), and 001876478VES (3/31/22)). According to CU Boulder representatives, Veolia stopped mailing return manifests in September 2021, but said that they should be available in the e-manifest module of RCRAinfo. CU Boulder representatives said that they would verify with Chris Quattrociocchi if the return manifests were available. CLOSING CONFERENCE We held a closing conference with Mr. Kupecz, Mr. Lapham, Mr. Wright, Mr. Boger, and Ms. GatesMayer in which I summarized the concerns that we had noted during the walk-through inspection and the records review. Areas of concern discussed in the closing conference: 1. In Museum Collections Room W130, one SAA 5-gallon carboy of ethanol was not labeled with an indication of the hazard. This container was properly labeled during the inspection. 2. In Ekeley Sciences M1B10, two full 5-gallon 90-day containers of hazardous waste acetone were not labeled with accumulation start dates. 3. Return manifests for five shipments in November 2021 and March 2022 were not available for inspection. 4. The 200 gallons of photo fluid in the ion exchange tank in the Chemical Treatment Room contained over 50 ppm silver (total), however a hazardous waste determination had not been made. According to Mr. Lapham, a TCLP analysis had not been run on the batch. The maximum TCLP concentration for a waste to be considered hazardous is 5.0 ppm silver. I also requested a list of the current SAAs throughout main campus. INSPECTION FOLLOW-UP Ms. Gates-Mayer, Interim Assistant Vice-Chancellor for EH&S, sent an email on September 14, 2022, detailing corrective actions that CU Boulder has taken in response to concerns identified during the inspection (Appendix B). According to this submittal, most of the deficiencies have been corrected, including: x The 5-gallon 90-day containers of hazardous waste acetone in Ekeley Sciences M1B10 were labeled with accumulation start dates and the 90-day area was more clearly defined. x The hard copies of the return manifests that were missing at the time of the inspection were printed and placed in the files for the respective shipments. The response included further information regarding the wastes containing trace pharmaceuticals observed in the EHSC 150 - Chemical Treatment Room. This letter summarizes CU-Boulder's response to some observed findings both in the labs on main campus, chemical treatment room, and retuned manifest copies. 1. EKLC M1B10 a. Observed: Two carboys of acetone for recycle were not clearly identified as 90-day waste with accumulation start dates. i. Response: They were fully labeled with our hazardous waste disposal tags to meet all hazardous waste regulations including a hazardous characteristic(s). Accumulation start date tags have been attached. The 90 day area was also designated with caution tape on the floor and a 90-day hazardous waste storage sign on the wall above the waste carboys. 1 M1B10: Hazardous waste tags attached, caution tape on floor M1B10: accumulation start date tags 2 M1B10: 90-day sign above the carboys 2. EHSC 150 (Chemical Treatment Room) a. Observed: Unidentified "Oxy" containing waste. i. Response: The material found in the chemical treatment room (EHSC 150) that was labeled "Oxy" are actually spent dilute oxycodone working solutions that were acquired during the most recent DEA controlled substance round up (7/12/22). One of the labs had asked if we could take the spent dilute oxycodone working solutions during the round up as a courtesy. The Hazmat supervisor accepted the material without obtaining a hazardous waste tag. In the process of organizing all the controlled substances and paperwork for the DEA disposal the working solutions got put aside and forgotten about. Although this was a unique situation this reinforces the need to stick with our waste acceptance protocols. Immediately following the discovery of the "Oxy" material in the chemical treatment room, the material was tagged as Non-RCRA regulated waste and eventually consolidated into our Non Regulated Liquids Toxic drum with the Veolia Profile# 065352. 3. EHSC 175 (Hazmat Office) a. Observed: Missing Returned Manifest Copies. i. Response: During the inspection it was found that there were several hazardous waste shipments ('21-'22) where the hard file was missing return manifest copies. Over the last 2 years Veolia 3 Environmental Services has been emailing the return manifest copies. All return manifest copies are saved in Hazmat's Offsite database shipment folders. Since the inspection, all missing return manifest copies from the hard file shipment folders have been printed and placed with their respective shipments. We believe that these actions taken have successfully corrected the non-compliance issues we observed during our campus inspection. This has been a great chance for us to improve our waste management process on campus, effectively increasing the overall safety of these lab areas and the entire campus.
