Dear Mr. Locker:
Thank you for your letter of July 9, 1980 which came to my attention on July l6, 1980. Evidently your letter of June 3, 1980 was never received in our Unit.
In response to the questions raised in your letter of June 3, 1980,
Dr. Bartos did examine :
in his office on June 15, 1979.
Evidently a copy of this report was never sent to your attention.
Attached is a copy of this report, In regard to Dr. Burnett's report,
his was a pre-employment physical that was given tc
before
she came to work for your company. I doubt whether the judge at the
Workers' Compensation Board made his decision based on that report.
Dr. J, Robert Smith had given testimony at one of the hearings. His
testimony plus the fact that benzene was a component of the products
being mixed at your store, were probably the basis for the judge's
decision. We have no report from any doctor indicating a direct rela
tionship between
employment and her leukemia. Since we
appealed the decision there has been no activity on the file. Attorney
Oot, who represents the claimant, had written a request to the Board
dated April 1, 1980 for another hearing to take the testimony of Dr.
Bartos. As yet, no hearing has been scheduled.
