The inspection was conducted by the authority of the Clean Water Act (CWA) to determine compliance with Environmental Protection Agency (EPA) regulations. BIA field inspector, Mike Perrier was present during the inspection. Lease owner Devin Robinson and lease operator Johnny Webb were present during the inspection. There was no other federal, state, or local agency representative present at the time of the inspection. FACILITY DESCRIPTION EPA conducted an inspection at the R&D Resources, Stoney #1 Lease where runoff water from recent heavy rainfall was pumped into oil/saltwater holding tanks by an automatic sump pump, causing the tanks to overflow into the facility's secondary containment. The secondary containment was overfilled, which released oil and saltwater onto the road, eventually entering the nearby county road conveyance (ditch). At the time of the inspection, the company estimated approximately 1.5 barrels of oil was released from the facility. Section II - OBSERVATIONS I observed the facility sign for the R&D Resources, Stoney #1 lease, see Photo No. 1. For additional GPS location information and photo metadata, please see Appendix 1 (photo log) attached to this report. I observed the release point of the spill. The spill overtopped the facility's secondary containment near the southwest corner, releasing a company-estimated 1.5 barrels of oil, see Photo No. 2. From the release point, I observed the overland flowpath of the release as spill impacts migrated toward the southwest. The flowpath primarily consisted of the gravel road ingress/egress associated with the facility, see Photo No. 3. I observed the point of entry (POE) of spill impacts into the conveyance (ditch) along Lynn Avenue, which ran along the west side of the facility, see Photo No. 4. On the west side of Lynn Avenue (across the road from the facility), I observed a significant area of oilstained soil and vegetation along the conveyance. At this same location, I observed a TDS field reading of 165.3 mg/L, see Photos No. 5 and 6. 2 R&D Resources / Stoney #1 Lease (CWA) Inspection Date 05/29/2025 On the south side of the intersection of Lynn Avenue and CR4070, I observed oil-stained vegetation in the conveyance, see Photo No. 7. I observed the end of spill impacts. The operator had placed an oil absorbent boom to prevent downstream migration of spill impacts. The boom was properly placed; and at the time of the inspection, the containment boom was effectively preventing downstream migration of spill impacts. At this same location, I observed a TDS field reading of 180.1 mg/L, see Photos No. 8 and 9. Soldier Creek was located approximately 180 feet downstream from the last observed spill impacts. I did observe Soldier Creek, but no spill impacts were present. Section III - AREAS OF CONCERN The primary area of concern was the oil-stained soil and vegetation along the roadside conveyance on the east and west sides of Lynn Avenue and the overland flowpath that was impacted by oil. An additional area of concern was the possibility of the same type of release recurring due to improper drainage systems at the responsible facility, which allowed excess stormwater runoff to enter the facility and overwhelm the secondary containment. Section IV - FOLLOW UP EPA inspector noted the areas of concern to the owner and operator of the facility during the inspection. A follow-up inspection was conducted on June 6, 2025. EPA inspector will conduct follow-up calls, field meetings and inspections to ensure the impacted area is returned to "pre-spill" condition.
