Dear colleagues,
We understand the difficulties raised by Flanders and their desire to compare their experience with that of other member stater to find a solution to the problem of PFAS. However, as pointed out, it is not possible to lower the level of requirements with regard to environmental protection.
This is why it seems to us that the latest proposai from the FPS health is a good compromise for relaunching the dialogue and we support it.

Dear colleagues,
Due to the time envisaged from the Flanders side, we suggest to have a slightly shorter text which can accommodate
both the need to initiate a discussion at EU level on how to proceed with the PFAS challenges that Flanders rightly
highlights, and the need to maintain a high level of health and environment protection.. This seems to us to go in the
same vein than the reaction from the FPS economy side (see
email from today).
We thus consider that the mandate should be on pointing a problem, asking for exchange of information, but not on seeking support on measures that are not yet clearly specified nor agreed and may have implications for both regional and federal levels as well as on the whole BE negotiation position on PFAS.
Thus, we make in attachment a proposal for a compromise that is quite complementary to what the FPS economy is suggesting.

Je partage I'avis de Simon concernant le point relatif au POP.
Je pense qu'une formulation plus courte et plus generale du type a o Without prejudice to our commitments in the implementation of the Stockholm Convention on Pollutant Organic Persistent chemicals and the European regulation implementing it, which strictly addresses issues related to certain PFAS (i.e PFOS, PFOA, PFHxS),.... conviendrait mieux pour clarifier que l'objectif de la note n'est pas de reduire le niveau d'ambition des accords internationaux et EU actuels et futures.

Ik kan enkel herhalen wat ik op de vorige nota gezegd heb...

Ik moet toegeven dat ik een dubbel gevoel heb bij deze nota.
Er worden inderdaad belangrijke punten aangehaald over het conflict tussen de eisen van de wetgeving en de praktische implicaties. Dan zijn er twee manieren om dat conflict op te lossen:
1. Aansturen op een versoepeling van de wetgeving, of 2. Nagaan hoe het probleem aangepakt kan worden.
Deze nota lijkt aan te sturen op het eerste. Dat lijkt me problematisch.
Er is een verschil tussen een pragmatische en praktische oplossing voor het probleem vragen en wat de nota doet uitschijnen, nl dat Vlaanderen bepaalde materialen voor bepaalde toepassingen wil blijven gebruiken, maar dat dit in conflict is met de stringente wetgeving
Er is uiteraard een reden dat de wetgeving strenger wordt. Volgens mij is dit geen overreactie van iedereen op EU- en lidstaatniveau als het gaat over PFAS De toon van de nota en datgene wat daarin lijkt gevraagd te worden, doet dan eerder uitschijnen dat Vlaanderen het status quo wil verdedigen dan een oplossing te zoeken voor het gedentificeerde probleem.
In de nota wordt het voorbeeld van het riet aangehaald. Ik neem aan dat de vervuilde grond rond 3M en de Oosterweelsite ook als voorbeeld had kunnen dienst doen om de problemen rond hergebruik te illustreren? Begrijp je waarom ik dit problematisch vind, zowel qua science-based policy (zero pollution) als politiek gezien.
Ik begrijp de additie rond de POPs in isolatie, maar in de context van de gehele tekst blijft het bizar. Waarom hou je je aan de regels voor hergebruik van grond/afval/etc voor PFOS en PFOA, maar lijkt dat een probleem voor de andere PFAS waarvoor ondertussen afdoende informatie is om dat hergebruik ook als problematisch te bestempelen. Dit is in mijn ogen niet consequent.
In bijlage enkele specifieke opmerkingen en voorstellen.

In annexe the proposed reformulated/adapted version for our envisaged AOB-PFOS (Council 24/10/22).
Hierbij werd getracht om in te gaan op de opmerkingen ontvangen tijdens de eerste DGE-procedure (zoals gisteren afgesloten zonder groen licht voor het toen voorgestelde), en tijdens de bespreking ervan op de CCIM SG Chemical products (SGCP).
Graag je evt. opmerkingen/suggesties/correcties duidelijk aangegeven in de tekst tegen ten laatste morgenmiddag 05/10/22, 12u30.
