Calo Co., Inc.) requesting a Material Safety Data Sheet (MSDS) for Vinsol resin. We recognize the Occupational Safety and Health Act imposes upon an employer the obligation to "furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious harm to his employees," and that maintenance by the employer of a file of subject data sheets for hazardous products is one of the requirements in meeting this obligation. However, as we interpret this Act, Vinsol resin should not be considered a hazardous material. We trust that this letter properly answers your inquiry.
