ALphough the act is based on the OSHA Hazard Communication St^jrdard, modifications were jnade to expand employer comw^e to most employers, provide State and Fire Sescieswith workplace chemical lists and MGPeT*-T-, to determine the validity of trade secrets, and require that the chemical lists be maintained for 40 years. Massachusetts Right-to-Know Law Regulations Regulations proposed by the State to implement the 1983 right-to-know law do not comport with the statutory language. New England Nuclear testified as did many industry representa tives on the proposed regulations at a hearing held 4/12. It is expected that some changes will be made before final promul gation of the regulations in May. The compliance deadline would be August. HAZARDOUS WASTE F&FP - Berlin & Farro Waste Facilities Ten companies, not including Du Pont, have reached agreement with EPA for surface cleanup of the Berlin & Farro superfund site in Michigan. Cost is estimated at $14MM. Documents found in Berlin & Farro records indicate that two shipments of waste paper were sent to Berlin & Farro from the Flint Plant for in cineration. FORNEY -2- April 19, 1984 WATER 0 Conoco Refineries - BAT Wastewater Guidelines EPA's guidelines for permissible "toxic" content of refinery wastewater effluents (BAT - Best Available Technology) were challenged by an environmenal group. Settlement was reached this week, with industry investment expected to reach $77MM to meet the new, more stringent limits. A preliminary review indicates that all Conoco refineries now meet the new guidelines and prob ably no new investment is needed. Pollutants involved are phenol and chromium. RRB:pt VVV 000J?294
