One of our witnesses who was 3 scheduled for tomorrow, Dr. DeLuca had a -- we were 4 called around noon -- had a death in his family and 5 went out of town until the beginning of next week. 6 We tried to check around over the evening. 7 We came up with a witness who we could call tomorrow 8 afternoon who was going to be called Monday, and as 9 soon as I found out that he was available around 1 10 o'clock, I called Ms. Tostanoski and Mr. McGowan and 11 told them that we would try to call him -- he is a 12 gentleman by the name of Joe Urps -- so we wouldn't 13 run short. 14 They, I believe, will have an objection to 15 that because of the timeliness, and I talked with Mr. 16 Marsh and the only other alternative I could come up 17 with is that we have another witness who we would be 18 calling in the Vandergucht case that we could do by 19 deposition, that we could give to Mr. McGowan. 20 Apparently, Mr. McGowan has a commitment and 21 has to be out of town tomorrow, but I don't want to --
