You will observe it is claimed by him that due to the faulty in stallation of a underground gasoline tank on his premises, leaded gasoline contained therein was permitted to leak therefrom and thereby rendering the water in the well on his premises "unfit and dangerous for human consumption* ` I also attach copy;:of a letter from our Birmingham office to me Sunder date February 2nd, 1958, which sets out the facts in connection with this case completely, together with report.of Dr* E* Dice Lineberry under date January 51st, 1958, and report of Dr. W. B. Martin of Deember 22nd, 1937* At the tine this matter was reported to us-on February 2nd, our Birmingham office communicated direct with Dr. Robert A* Kehoe ati. \ Cincinnati. I am also enclosing herewith copy of Dr. Kehoe's letter to me following receipt of the letter from our Blrminghamoffice. ` Thereupon, I communicated with Dr* Kehoe suggesting that possibly he wouli prefer to have one of his assistants go to Birmingham with a ./ view of making a physical examination of Mr* Florence* Previous to * that, the attorney which plaintiff had employed was agreeable that the examination be made of his client by a doctor selected b y o u r company* However, a second attorney was associated In the case and upon the arrival of Dr* Schradin in Birmingham, the second attorney , refused to permit, such an examination* I enclose herewith a copy "of Dr* Kehoe's letter to me of April 26th, 1938 reporting that fact* I am likewise sending a copy of the complaint, with a copy of this' letter to Dr. Kehoe for his Information* . #2 - Mr* E.W.Webb, etc* Jure 15th, 1958* It may be that he has already written you concerning this matter; however, the thought occurred to me that you would be Interested and am passing the enclosed to you for your information* Encs* h e Dr* Robert A.
