KNOW ALL MEN BY ISE PRESENTS:
That I, J. PATRICK McGLOIII, TRUSTEE, of the County of
Nueces, State of Texas, for and in consideration of the cun' of
Ten Dollars ($10.00) and other good and valuable consideration
to me in hand paid by the Grantee herein named, the receipt of
which is hereby acknowledged, and the further consideration of
the assumption and agreement by Grantee to pay that certain
promissory note dated Cctober 1, 1971, in the principal sum of
One Hundred Two Thousand Dollars ($102,000.00), payable to the
order of Conrad M. Bluciier and wife, Tula E. Elueher, bearing
interest at the rate of six nerccnt (6/) per annum, and being
payable in five (5) annual installments as therein provided, the

deed of even date therewith to the hereinafter described prop
erty from Conrad M. Blucher and wife, Zula E. Elueher, to J. P.
McGloln, Trustee, and which note is additionally secured by a
deed of trust of even date therewith to the same property to
James C. Schmidt, Trustee, have GRANTED, SOLD end CONVEYED, and
by these presents do GRANT, SELL and CONVEY unto SUNTIDE REFINING
COMPANY, t Delaware corporation, all of the six (6) tracts of
land in Nueces County, Texas, depicted on Exhibit "A" attached
hereto and made a part hereof for all purposes, v:hich said six
(6) tracts are more particularly described as follows, to-wit:
FIRST TRACT:
9.89 acres of land In the 16.6-acre Van Branch tract in D. S. & F. Survey No. ^21, A-572, more particularly described by metes and bounds as follows:
BEGINNING at the Northeast corner of a 3 /1-8-acre tract of land owned by John J. Morales, for the Northwest corner of this tract;
THENCE South 89" 37' 50" East, with the North boundary of said Van Branch tract, 822.56 feet to a 5/8" iron pipe at the Northeast corner of

BEGINNING at a 1 inch iron pipe in the West rlght-cf-way line of a 60 foot county road called Tecoiote Road, for the Northeast corner of a tract of land owned by the Southern Minerals Corporation, and an interior corner of this tract;
THENCE with the North boundary of said Southern Minerals Corporation Tract, H 62 47' 30" W, 419-35 feet and N 69 35' 30" W, 209.50 feet to a 1 inch iron pipe at the Southeast corner of a 3.28-acre tract owned by 0. L. Carson for the Southwest corner of this tract;

This conveyance is made and accepted subject to the follow
ing matters to the extent sane affect the above described land and
to the extent same are in effect at this time:
(a) Any and a31 restrictions, covenants and condi
tions and easements, if any, relating to the hereinabove described
pronert.y shown of record in Nueces County, Texas.
(b) All zoning laws, regulations and ordinances of
municipal and/or other governmental authorities, if any, relating
to the hereinabove described property.
(c) Mineral reservation contained in a certain deed
from the Estate of William Singer, Deceased, to Conrad Blucher,
dated March 29- 1948, recorded in Volume 392, Fage 393j of the

Ward McCampbell, et al, to Conrad M. Blucher, dated April 28,

(f) Royalty Deed from Henry Branch to Lois Smith,
dated September 23, 1931, recorded in Volume 11, at Page 687,
of the Oil and Gas Lease Records of Nueces County, Texas, and

(g) Oil, Gas and Mineral Lease dated May 29, 1969,
from Conrad Blucher, et ux, to Burns Trust No. 2, recorded in
volume 278, at Page 238, of the Oil and Gas Lease Records of
Nueces County, Texas.
TO iiAVE AND TO HOLD the above described premises, to
gether with all and singular the rights and appurtenances thereto
in anywise belonging unto the said Grantee, its successors and
assigns forever; arid I do hereby bind myself and my successors
to warrant and forever defend all and singular the said premises
unto the said Grantee, its successors and assigns, against ever,
person whomsoever lawfully claiming or to claim the same, or
p any part thereof, except as above stated, and except, further, as to current ad valorem taxes, the payment of which is assumed
by Grantee.
But it is expressly agreed that the vendor's lien, as
well as the superior title in and to the above described
premises, is retained against the above described property,
premises and improvements until the above aeserjbed note and
all interest thereon are fully paid according to the face.
