Warne Toronto Hew York January 26, I960 In accordance with our conversation of yesterday concerning tetramethy1 lead and the inquiry you have received from Standard Oil of British Columbia, this memorandum will undertake to summarize our present informa tion. As general background, I am attaching the informa tion sheet which the Sales Department has furnished to its people. We are now working out a contract with Standard oil of California - Western Operations,, Inc., to supply them with TML. It is quite probable that tbi3 commitment will exceed our production until July 1 so that it would be necessary to arrange some form of release from Standard of Gal* in favor of Standard of B. C. I am sure that there would be no difficulty about doing so. Completely informal discussions have commenced with representatives of the Office of the Burgeon General and at this time no report can b made concerning the out come. However, w are hopeful that in not too long a time we will be in a position to take action on our own responsi bility to release TML for commercial sale, tie do not expect to obtain any kind of approval or even official or formal expression of opinion by the Office of the Surgeon General. The matter will be left to the TEL manufacturers to pro ceed on their own responsibility, but without any affirma tive objection by the Surgeon General. Sale in California will also require some dealing with California authorities, but at this particular moment the manner of doing so is not settled. The use of TML in gasoline in the marketing area of Standard of 3. C. raises a question of dealing with such provincial health authorities as are concerned. This raises the question of what kind of contact shall be made with the provincial health authorities and by whom. At present we believe the sale of TML should be dealt with by a separate form of contract and I am asking Fred Warne to undertake the drafting of an appropriate form for sale to standard of B. C. So far as patent coverage is concerned, Socony Mobil has announced that it has applied for a patent.
